Could Gov. Jerry Brown have been so careless as to appoint someone unqualified? According to the suit filed in Sacramento County Superior Court by rival candidate Eric Early, Becerra cannot serve because he was listed as “inactive” from 1991 to 2017 in the state bar. State law requires the attorney general to have been “admitted to practice” before the state Supreme Court for five years before taking office. Eric Early, a Republican lawyer who ran unsuccessfully against Becerra and two other attorney general candidates in the June primary, filed suit in May arguing the appointed incumbent doesn’t meet the statutory requirements for the post. He said Wednesday that he will appeal. “We’re disappointed but not surprised,” Early said after Wednesday’s ruling. “That would have been a difficult ruling for a trial court judge to make to remove Mr. Becerra from the ballot in the general election. Feb. 5, 2019, 1:23 PM GMT By Suzanne Gamboa When California's attorney general counters the president’s State of the Union address with the Democrats' Spanish language rebuttal Tuesday, it won’t be the first time Xavier Becerra has taken swings at Donald Trump's policies. In fact, according to the Democrats, Becerra has filed more than 100 legal actions — 45 of them lawsuits — against the Trump administration. Becerra's response will be delivered through Spanish language media outlets live Tuesday night, while Stacey Abrams, who ran unsuccessfully for Georgia governor, will deliver the Democratic response in English. This will be the first time the Spanish-language Democratic response has been delivered live, a Democratic aide said. For those who tune in, Becerra said they can expect some tough talk.
