The self-published author of an erotic novel will have to submit to a psychiatric examination in her suit claiming Allen & Overy used the book as a pretext to fire her.Plaintiff Deidre Clark, who had worked as a senior lawyer in the firm’s Moscow office, must have the exam because her $15 million emotional distress claim made her mental state a matter of controversy, according to New York’s Appellate Division, First Department. The Am Law Litigation Daily has a report on the Feb. 17 decision.In addition to intentional infliction of emotional distress, Clark’s suit alleged sexual harassment and retaliatory discharge.Clark, who used the pen name Deidre Dare to write her novel Expat, claims she was fired after a sexual encounter with a former Moscow partner. A former lawyer with a construction law firm based in Philadelphia has filed a lawsuit accusing her one-time employer of improperly firing her and then misappropriating her likeness by keeping her photo on its website.The suit by Melissa Angeline also accuses law firm Cohen Seglias Pallas Greenhall & Furman of defaming her by asserting she was fired for poor performance, the Legal Intelligencer reports in a story reprinted by the Pittsburgh Post-Gazette.Angeline alleges she was fired in October 2012 for taking time off under the Family and Medical Leave Act, though she was told she was “temporarily laid off because of a lack of work,” the story says. The former managing counsel for Toyota Motor Sales USA has filed a lawsuit against his former employer alleging the automaker destroyed evidence in hundreds of rollover suits, leading to his mental breakdown and firing.The racketeering suit by Dimitrios Biller claims Toyota destroyed evidence in a “ruthless conspiracy” to keep the information secret, CBS News reports.
