Health IT Update: Food and Drug Administration Safety and Innovation Act (FDASIA) Health IT Report Issued by FDA, FCC, and ONC

On April 3, the Food and Drug Administration (FDA), the Federal Communications Commission (FCC), and the Office of the National Coordinator for Health Information Technology (ONC) jointly issued a report that sets forth a proposed strategy and recommendations for a risk-based regulatory framework for health information technology (health IT). The report, which was mandated by Congress in the Food and Drug Administration Safety and Innovation Act (FDASIA), proposes that no new or additional regulations are needed to implement this regulatory framework. ERISA Preempts Vermont Health Plan Reporting Law, Supreme Court Holds (Self-Funded Plans Take Note)

Many employers would agree that reporting is a core function of employee benefit plan administration. On top of the numerous reporting requirements for group health plans imposed by the Internal Revenue Service and other federal agencies, states laws, including Vermont’s, add a layer of state reporting obligations for plans, including self-funded group health plans. In welcome news for employers and plan sponsors, this added state law burden has been lessened by the U.S. Supreme Court’s finding that certain state laws are preempted by federal law. Gobeille v. Liberty Mutual Ins. Co., No. 14-181 (Mar. 1, 2016).The Court decided in Gobeille that state reporting mandates, like the one in Vermont, are preempted by the Employee Retirement Income Security Act of 1974 (ERISA). Health inspection reports for nursing homes in Lancaster County through March 2018

There are 32 nursing homes in Lancaster County, which are inspected by the Pennsylvania Department of Health.The following is a list of all nursing home health inspection reports released since Feb. 19, with links to the reports that document inspectors' findings for each home. They're also available here. Much additional information on each home is available on the Medicare Nursing Home Compare website.Standard inspections are performed annually, unannounced. Complaint inspections are performed when a complaint about a nursing home is registered with the department.Deficiencies are ranked from least to most serious, as follows: potential harm, minimal harm, actual harm and immediate jeopardy.Minimal harm deficiencies are listed below. Lancaster County has 32 nursing homes, which are inspected by the Pennsylvania Department of Health.
