‘Dangerous For Children’: Madras HC Prohibits Downloading Of TikTok Mobile Application

By: LIVELAW NEWS NETWORK 3 April 2019 3:58 PM GMT The Madras High Court has directed the state authorities to prohibit downloading of TikTok Mobile Application. The bench comprising Justice N. Kirubakaran and Justice SS Sundar has also prohibited media from telecasting the videos made using TikTok Mobile App. The bench has also asked the Central Government whether it will enact a statue like Children's Online Privacy Protection Act, enacted by the United States, to prevent children becoming cyber/online victims. The court was considering a petition seeking ban of TikTok. The petitioner contended that the app is degrading culture and encouraging pornography. He submitted before the court that the children, by using the said application, become vulnerable and exposed to sexual predators. 15% Service Tax On Downloads From Foreign Websites [Read Notification]

Come December 1st and you will have to shell out some extra money for downloading book, movies and the rest from foreign websites. The Central Board of Excise and Customs (CBEC) has amended existing rules to pave way for an additional levy of 15 per cent service tax on all downloads from foreign sites.The CBEC’s much sought amendments to the existing Place of Provisions of Services Rules (PPSR) for online information and database access or retrieval services aims to bring about uniformity and equality among local and foreign website and service providers. The move comes as a relief to Indian service providers who were putting pressure on the government for the same.The amendments seek to bring about a level playing field for the local and overseas players. US Supreme Court rules natural human genes cannot be patented [Download Judgment]

In a path-breaking judgment, the US Supreme Court unanimously held that natural human genes are not patentable. The decision will have huge implications and will force a change at the federal patent office, which has been awarding gene patents since 1982.Sandra Park, an attorney with the American Civil Liberties Union, which sued to challenge the Myriad patents told Bloomberg, “Because of this ruling, patients will have greater access to genetic testing and scientists can engage in research on these genes without fear of being sued”.Speaking to Live Law, Prof. Shamnad Basheer (Ministry of HRD Chair Professor for Intellectual Property at NUJS, Kolkata) said, “The US Supreme Court decision is very welcome and sends out a clear message that products of nature cannot be appropriated through patents. Advocates who enrolled after July 2010 to submit new Declaration Form: BCI [Read Notification & Download the form]

The Bar Council of India has issued a circular notifying all State Bar Councils to ask for submission of Declaration forms from the advocates enrolled after July 2010.The notification entails submission of necessary information in a prescribed format required for preparation of electoral rolls for elections to the State Bar Councils and also to update the existing ones.The State Bar Councils are advised to take up the matter with prompt attention and circulate the format to all Bar Associations.
