Vandal Spray-Painted Statue of Doctor Who Experimented on Female Slaves

· August 27, 2017 ·

A statue of Dr. J. Marion Sims, the founder of gynecology, stands on Fifth Avenue and 103rd street in East Harlem. And, at least until Sunday afternoon, its back-end was spray-painted with the word “Racist.” WCBS 880 reported that his eyes and neck were also graffitied. No one has been arrested for the incident. The New York Police Department is investigating.Sims, an Alabama native, revolutionized the way doctors treat fistulas, and set the stage for modern gynecology. His research culminated in 1849. Problem was, he perfected his treatment on slave women, who, at best, were not in a position to say no to a white man. And he did it all without anesthesia. Despite initial fame, his stock fell in the 1970s thanks to changing attitudes about race in America, according to a New York Times profile. In any case, he claimed that his patients wanted him to perform the treatments. The vandalism comes after New York City Council Speaker Melissa Mark-Viverito and other local … [Read more...] about Vandal Spray-Painted Statue of Doctor Who Experimented on Female Slaves

Molinaro rejects Cuomo’s radio debate proposal, calling it ‘a staged fraud’

· October 19, 2018 ·

ALBANY – Under growing pressure, Gov. Andrew M. Cuomo, never a fan of public debates with his opponents, on Friday appeared to set the stage for a quick-hit debate that he proposed be held early Saturday morning on a radio station that airs in New York City. Not so fast said Molinaro, who for months has been urging Cuomo to debate. The Republican candidate quickly rejected what he characterized as a haphazardly devised debate with a format put together seemingly on the fly by Cuomo and his radio interviewers. And other minor party candidates, cut out of the one-on-one plan accepted by Cuomo, called any such format unfair to them. “I have no problem fighting against the forces of hate. I don’t. I don’t think it’s an especially constructive dialogue,’’ Cuomo told WCBS radio in New York this morning as interviewers sought to get him to commit to a one-on-one debate with Molinaro. But then, Cuomo said, “If you want to do it Mr. Molinaro, if … [Read more...] about Molinaro rejects Cuomo’s radio debate proposal, calling it ‘a staged fraud’

Functional Claim Language, USPTO Training & Williamson: A Mechanical Perspective

· November 4, 2016 ·

In June of 2013, President Obama announced several legislative recommendations and executive actions stemming from a White House Task Force on High-Tech Patent Issues.[2]  One area of attention for the task force focuses upon perceived dangers of claim terms that refer to the function of an invention as opposed to its tangible structure.  Such terms are seen as inherently less specific than structural terms, thus hindering the public’s ability to understand and appreciate the scope of issued patents.  This lack of transparency of the patent system undermines the effectiveness of our innovation incentive program and hinders the ability of other innovators to build up or design around prior patented technology. In response to this concern over patent clarity, the President’s second executive action addresses functional claim language:Executive Action 2:  Tightening Functional Claiming (renamed as “Clarity in Patent … [Read more...] about Functional Claim Language, USPTO Training & Williamson: A Mechanical Perspective

Why Is This Happening? How to block Big Tech with Kashmir Hill ǀ View

· February 19, 2019 ·

How soon after waking up do you check your phone? Do you compulsively refresh your Twitter feed? Can you find your way around without Google Maps? There are many obvious and tactile ways in which Silicon Valley has its hooks in our everyday lives. And as we see Big Tech face increased scrutiny, people are becoming more conscious of their interactions with their products: limiting screen time, quitting Facebook, shopping locally. But fully divorcing yourself from these companies is a lot harder than you may think, as journalist Kashmir Hill discovered. Because besides our obvious interactions with Big Tech, there are many more invisible ways these products and innovations touch our lives. This is Kashmir’s story of what happens when you shine a light on those unseen encounters. KASHMIR HILL: I turn off my phone at night, like at 8:00 or 9:00 p.m. I just turn it off, which I used to never do. My phone would be on until the battery died. And that would be a very traumatic event. … [Read more...] about Why Is This Happening? How to block Big Tech with Kashmir Hill ǀ View

Indian Nations Law Update – November 2017 Selected court decisions

· November 8, 2017 ·

In Makah Indian Tribe v. Quileute Indian Tribe, 2017 WL 4767073 (9th Cir. 2017), Washington tribes had ceded lands to the United States through a series of treaties, including the 1855 Treaty of Olympia, negotiated by Governor Stevens (Stevens Treaties), which reserved to the tribes the "right of taking fish at all usual and accustomed grounds and stations" (U&A). The United States sued the State of Washington in the federal court for the Western District of Washington in 1970 to establish the continued validity of tribal treaty rights reserved in the Stevens-negotiated treaties. In 1974, Judge Boldt established standards and procedures for determining a tribe’s U&A, made U&A determinations for several tribes and reserved jurisdiction to determine subsequent disputes. In the instant case, the Quileute and Quinault tribes sought a determination under the Treaty of Olympia, that the right of taking fish include the right of taking seals and whales. Over the … [Read more...] about Indian Nations Law Update – November 2017 Selected court decisions
