Blue Art Limited, a UK company (“Blue Art”), is suing art dealer David Zwirner and his gallery, a contemporary art gallery in New York and London, for breach of contract and fraudulent concealment and inducement, regarding an unnamed piece by an undisclosed artist. Blue Art is owned by Old Master art dealer Fabrizio Moretti who has galleries in Florence, London and New York. The complaint was filed on July 20, 2016 in New York state court (Docket No. 653810/2016).Blue Art alleges that in June 2014, it agreed to buy a work from Zwirner for $2 million, and that at the time of the deal, Zwirner told Moretti that the work was in the process of being manufactured by the artist’s studio. A Manhattan art gallery has been hit with a lawsuit — the second in one week — for allegedly failing to deliver a multi-million-dollar Jeff Koons sculpture. Los Angeles-based Lethal Weapons films producer Joel Silver bought an $8 million piece by the celebrated artist from Gagosian Gallery in February 2014 — but claims he never got it. According to a Manhattan Supreme Court suit filed Monday, Silver initially put down $3.2 million, agreeing to make additional payments until the total was covered.
