Newsom picks 1st Latina state Supreme Court chief justice

Gavin Newsom on Wednesday nominated Patricia Guerrero to be the state's next chief justice, picking the daughter of Mexican immigrants to lead the nation's largest judicial system. Guerrero, 50, would replace Chief Justice Tani Cantil-Sakauye, who will step down once her term ends in January. Guerrero made history earlier this year when she was the first Latina confirmed to the California Supreme Court. Now she's poised to do it again as the first Latina to lead the state's sprawling court system that includes about 2,175 judges across 58 trial courts and 105 justices on the Courts of Appeal. “Justice Guerrero has established herself as a widely respected jurist with a formidable intellect and command of the law and deep commitment to equal justice and public service,” Newsom said in a news release announcing Guerrero’s nomination. Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court

The Supreme Court on Wednesday transferred FIRs registered against former BJP spokeswoman Nupur Sharma in the Prophet remarks row to the Delhi Police. The Delhi Police would also investigate in case any FIRs are registered in the future against Ms. Sharma, the court said. A Special Bench of Justices Surya Kant and J.B. Pardiwala gave Ms. Sharma liberty to approach the Delhi High Court seeking to quash the cases against her. The court refused a suggestion made by West Bengal counsel and senior advocate Menaka Guruswamy for a joint special investigation team to probe the case under the supervision of the apex court. The Bench said an FIR has been filed against Ms. Sharma in Delhi with the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police, and this specialised branch could carry on the probe in all the FIRs. Justice U U Lalit to Be New CJI: From Mumbai’s GLC to Landmark Kerala Temple, Triple Talaq Judgments

Appointed as the 49th Chief Justice of India, seniormost judge of the Supreme Court Justice Uday Umesh Lalit studied at the Government Law College in Mumbai and specialised in criminal law. He has been part of several landmark judgments, including the one which held the practice of divorce through instant ‘triple talaq’ among Muslims illegal and unconstitutional. He will succeed incumbent CJI NV Ramana . He will take the oath of office on August 27 and will retire on November 8. His tenure as the CJI will last only 74 days. He will be the second CJI who was directly elevated to the apex court Bench from the Bar. Justice S M Sikri, who became the 13th CJI in January 1971, was the first lawyer to be elevated directly to the top court bench in March 1964. Justice Uday Umesh Lalit Appointed 49th Chief Justice of India, Will Succeed CJI Ramana

Supreme Court’s senior-most judge Justice UU Lalit was on Wednesday appointed as the 49th Chief Justice of India. He will succeed incumbent CJI NV Ramana, who demits office on August 26. “In exercise of the power conferred by the Constitution of India, the President of India is pleased to appoint Shri Justice Uday Umesh Lalit, Judge of the Supreme Court as the Chief Justice of India with effect from 27th August, 2022,” according to an official notification. Justice Lalit, a renowned senior advocate, has become the second CJI to be directly elevated to the Supreme Court Bench from the Bar. Prior to this, Justice SM Sikri, who was the 13th CJI of India appointed in January 1971, was the first lawyer to be elevated directly to the SC bench in March 1964. Lalit was designated as a senior advocate by the top court in April 2004. In January 1986, he shifted his practice to Delhi. Recently, the Chief Justice of India objected to the lack of media accountability in the media’s coverage of legal issues. His remarks came less than a month after the Delhi police admitted to informing the media about the outcome of AltNews’ co-founder Mohammed Zubair ’s bail hearing before the judicial order was even pronounced in open court. While the matter of how this information was known to the police remains an open issue, it is problematic that a considerable portion of its news coverage depicted the remarks of the police officer as fact without waiting for the judicial order. New Delhi: The Supreme Court on Thursday deferred the hearing in the Ayodhya title dispute case to January 29 after Justice UU Lalit, who was part of a Constitution bench to hear the case, recused himself on Thursday. Justice Lalit appeared for former Uttar Pradesh chief minister Kalyan Singh in 1994, senior advocate Rajeev Dhavan — who was appearing for the Muslim petitioners — told the bench headed by Chief Justice Ranjan Gogoi soon after the court assembled. Though Dhavan said he was not seeking Justice Lalit's recusal, the judge opted out of the hearing in the matter. The bench, also comprising Justices SA Bobde, NV Ramana and DY Chandrachud, noted the submissions made by Dhavan. Watchdog Files Court Motion To Unseal FBI Search Warrant On Trump’s Home

A conservative watchdog filed a motion Tuesday urging a district court to unseal the FBI’s search warrant on former President Donald Trump’s Mar-a-Lago home Monday in Palm Beach, Florida. “Given the political context, and the highly unusual action of executing a search warrant at the residence of a former President and likely future political opponent, it is essential that the public understands as soon as possible the basis for the government’s action,” states the motion, which was filed by Judicial Watch in the U.S. District Court for the Southern District of Florida. “Any government interest in securing the identities of witnesses and confidential sources, if any, may be addressed by appropriate redactions from the search warrant affidavit,” according to the motion.
