Hearing the petition filed by KN Govindacharya in relation to non-payment of taxes by foreign internet companies, especially Facebook and Google in India, the Delhi High Court today asked the Union government about the same.The Court was dealing with the issue of non-payment of service tax by such entities. The government had submitted an affidavit signed by Commissioner of Service Tax which stated that “as per the provisions of Chapter-V of the Finance Act, 1994,any company/entity having fixed establishment inside India, that provides or agrees to provide service of sale of space or time slots for advertisements to a person in Indian territory, is subjected to service tax as per the provisions of the Finance Act.”Arguing for the Petitioner, Mr. Virag Gupta submitted that the statement made in the affidavit is wrong and that any entity, irrespective of the fact where it has a fixed establishment in India or not is liable to pay service tax. Venezuela’s state oil company Petroleum of Venezuela (PDVSA) is facing a lawsuit in the United States for failing to pay $25 million owed to Canadian energy contractor SNC-Lavalin.
