Gavin Newsom on Wednesday nominated Patricia Guerrero to be the state's next chief justice, picking the daughter of Mexican immigrants to lead the nation's largest judicial system. Guerrero, 50, would replace Chief Justice Tani Cantil-Sakauye, who will step down once her term ends in January. Guerrero made history earlier this year when she was the first Latina confirmed to the California Supreme Court. Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court
The Supreme Court on Wednesday transferred FIRs registered against former BJP spokeswoman Nupur Sharma in the Prophet remarks row to the Delhi Police. The Delhi Police would also investigate in case any FIRs are registered in the future against Ms. Sharma, the court said. A Special Bench of Justices Surya Kant and J.B. Pardiwala gave Ms. Sharma liberty to approach the Delhi High Court seeking to quash the cases against her. The court refused a suggestion made by West Bengal counsel and senior advocate Menaka Guruswamy for a joint special investigation team to probe the case under the supervision of the apex court. The Bench said an FIR has been filed against Ms. Sharma in Delhi with the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police, and this specialised branch could carry on the probe in all the FIRs. Noida Twin Towers: Status Report on Demolition Preparation to be Filed in SC on Thursday
The Noida Authority will on Thursday file in the Supreme Court the status report on preparations for the demolition of Supertech's illegal twin towers in the city, officials said, as it appeared that the blast date could be deferred from August 21. The apex court, which had ordered the demolition of the nearly 100-meter-tall structures, will take up the matter for hearing on August 12, according to the officials. The twin towers in Sector 93A are so far scheduled to be razed by the controlled implosion at 2.30 pm on August 21. The Supreme Court had ordered their demolition by August 28. The time between August 21 and 28 was kept as a buffer period. The charging–rigging of explosives inside the structures-process in the twin towers is yet to begin. It would take around 15 days to charge the buildings. The approval of the CBRI, the technical expert on the project appointed by the Supreme Court, is pending, an official said, requesting anonymity. Supreme Court’s senior-most judge Justice UU Lalit was on Wednesday appointed as the 49th Chief Justice of India. He will succeed incumbent CJI NV Ramana, who demits office on August 26. “In exercise of the power conferred by the Constitution of India, the President of India is pleased to appoint Shri Justice Uday Umesh Lalit, Judge of the Supreme Court as the Chief Justice of India with effect from 27th August, 2022,” according to an official notification. Justice Lalit, a renowned senior advocate, has become the second CJI to be directly elevated to the Supreme Court Bench from the Bar. Prior to this, Justice SM Sikri, who was the 13th CJI of India appointed in January 1971, was the first lawyer to be elevated directly to the SC bench in March 1964. ‘Most Important Ingredient for Sexual Assault is Sexual Intent’: SC Quashes Bombay HC’s ‘Skin-to-Skin’ Order
The Supreme Court on Thursday quashed the Bombay High Court’s verdict which had held that no offence of sexual assault under the POCSO Act is made out if there is no direct skin-to-skin’ contact between accused and the victim. A Bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi held that the ingredient of the offence of ‘sexual assault’ under POCSO is sexual intent and skin to skin contact in such incidents is not relevant. The law has to be given an interpretation that gives effect to the intention of legislature instead of defeating it, the Court underscored. “The most important ingredient for constituting the offence of sexual assault is sexual intent and not skin to skin contact with the child. Construction of a rule should give effect to rule rather than destroying it. The intention of legislature cannot be given effect to unless wider interpretation is given,” the Court said.
