Last week, the Commodity Futures Trading Commission published its highly anticipated supplemental notice of proposed rulemaking regarding Regulation Automated Trading, initially released in November 2015. It contains new proposals regarding Floor Trader registration and who might be deemed a so-called “AT Person” in an effort to reduce the number of persons that might be subject to the harshest of the proposal’s requirements. However, the revised proposal also substantially broadens the concept of direct electronic access; indirectly subjects third-party algorithmic trading system providers to CFTC requirements; and still enables the CFTC to request an AT Person’s algorithmic trading source code through its inspection authority – albeit using special calls expressly authorized by the Commission – in addition to by subpoena. Political Newcomer Aims to Bring ‘Blue Wave’ to NYC’s Only Republican Congressional District

New York City's only Republican congressional district could fall in November if a young combat veteran can convince many of the district's Democrats to vote for their party, for a change. New York's 11th Congressional District, made up mostly of Staten Island and its "Reagan Democrats," has twice sent Republican Rep. Daniel Donovan to Congress. He's betting that his support of President Donald Trump won't hurt him in the majority-Democrat district — especially since he's taken a couple of key votes against Trump's agenda, on taxes and health care. House Democrats Promise Action on LGBTQ Rights Bill Trying to unseat Donovan is newcomer Max Rose, whose campaign emphasizes that he's a veteran of the war in Afghanistan and a former health care professional — the district has been hard hit by the opioid crisis. Bobbie Cheema-Grubb QC: First Asian woman to become a High Court Judge in Britain

One of the most senior prosecuting barristers in the country, Bobbie Cheema-Grubb QC, has become the first Asian woman to become a High Court Judge in Britain.The mother-of-three currently works as a Senior Treasury Counsel, and she will take up her new post on 23rd November 2015, in the Queen’s Bench Division, dealing with negligence, defamation, personal injury and land disputes.The 49-year-old was called to the bar in 1989 before taking silk in 2013.In 2007, she was appointed as a recorder and has sat as a deputy High Court judge.Her recent cases include those of Peter Ball, imprisoned for 32 months after he was found guilty of sexually abusing young priests 22 years after the allegations were first made and former barrister and recorder Constance Briscoe, who was found guilty of three charges of perverting the course of justice in 2014 and was sentenced to 16 months in prison at the Old Bailey.Mrs Cheema-Grubb is a member of 2 Hare Court. Bridging the Week: August 10 – 14 and 17, 2015 (Hacking, Layering, Dark Pools; Manipulation, Position Limits and Fiduciary Duties)

Enforcement actions – both in the United Kingdom and the United States – dominated the most notable developments regarding financial services firms last week. In the US, a network of 32 persons were charged civilly by the SEC and some defendants were also criminally indicted by the US Department of Justice for hacking into newswires, and trading on non-public information prior to the information’s public distribution. In the UK, five defendants were fined the equivalent of almost US $12 million for manipulative trading activity; while back in the US, an administrative law judge upheld FERC charges that BP Group companies manipulated natural gas prices in Houston, Texas, to benefit their trading position following a hurricane in 2008. U.S. troops in Iraq were rolling into battle in underequipped Humvees. Huntsville, Ala.-based Axion had a contract to build Hum­vee ma­chine-gun mounts.
