Gavin Newsom on Wednesday nominated Patricia Guerrero to be the state's next chief justice, picking the daughter of Mexican immigrants to lead the nation's largest judicial system. Guerrero, 50, would replace Chief Justice Tani Cantil-Sakauye, who will step down once her term ends in January. Guerrero made history earlier this year when she was the first Latina confirmed to the California Supreme Court. Now she's poised to do it again as the first Latina to lead the state's sprawling court system that includes about 2,175 judges across 58 trial courts and 105 justices on the Courts of Appeal. “Justice Guerrero has established herself as a widely respected jurist with a formidable intellect and command of the law and deep commitment to equal justice and public service,” Newsom said in a news release announcing Guerrero’s nomination. Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court

The Supreme Court on Wednesday transferred FIRs registered against former BJP spokeswoman Nupur Sharma in the Prophet remarks row to the Delhi Police. The Delhi Police would also investigate in case any FIRs are registered in the future against Ms. Sharma, the court said. A Special Bench of Justices Surya Kant and J.B. Pardiwala gave Ms. Sharma liberty to approach the Delhi High Court seeking to quash the cases against her. The court refused a suggestion made by West Bengal counsel and senior advocate Menaka Guruswamy for a joint special investigation team to probe the case under the supervision of the apex court. The Bench said an FIR has been filed against Ms. Sharma in Delhi with the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police, and this specialised branch could carry on the probe in all the FIRs. The IFSO could collect information necessary for its investigation from other states. Recently, the Chief Justice of India objected to the lack of media accountability in the media’s coverage of legal issues. His remarks came less than a month after the Delhi police admitted to informing the media about the outcome of AltNews’ co-founder Mohammed Zubair ’s bail hearing before the judicial order was even pronounced in open court. While the matter of how this information was known to the police remains an open issue, it is problematic that a considerable portion of its news coverage depicted the remarks of the police officer as fact without waiting for the judicial order. The case of a Nebraska woman charged with helping her teenage daughter end her pregnancy after investigators obtained Facebook messages between the two has raised fresh concerns about data privacy in the post-Roe world. Since before the U.S. Supreme Court overturned Roe v. Wade in June, Big Tech companies that collect personal details of their users have faced new calls to limit that tracking and surveillance amid fears that law enforcement or vigilantes could use those data troves against people seeking abortions or those who try to help them. Meta, which owns Facebook, said Tuesday it received warrants requesting messages in the Nebraska case from local law enforcement on June 7, before the Supreme Court decision overriding Roe came down. Noida Twin Towers: Status Report on Demolition Preparation to be Filed in SC on Thursday

The Noida Authority will on Thursday file in the Supreme Court the status report on preparations for the demolition of Supertech's illegal twin towers in the city, officials said, as it appeared that the blast date could be deferred from August 21. The apex court, which had ordered the demolition of the nearly 100-meter-tall structures, will take up the matter for hearing on August 12, according to the officials. The twin towers in Sector 93A are so far scheduled to be razed by the controlled implosion at 2.30 pm on August 21. The Supreme Court had ordered their demolition by August 28. The time between August 21 and 28 was kept as a buffer period. The charging–rigging of explosives inside the structures-process in the twin towers is yet to begin. Justice Uday Umesh Lalit Appointed 49th Chief Justice of India, Will Succeed CJI Ramana

Supreme Court’s senior-most judge Justice UU Lalit was on Wednesday appointed as the 49th Chief Justice of India. He will succeed incumbent CJI NV Ramana, who demits office on August 26. “In exercise of the power conferred by the Constitution of India, the President of India is pleased to appoint Shri Justice Uday Umesh Lalit, Judge of the Supreme Court as the Chief Justice of India with effect from 27th August, 2022,” according to an official notification. Justice Lalit, a renowned senior advocate, has become the second CJI to be directly elevated to the Supreme Court Bench from the Bar. Prior to this, Justice SM Sikri, who was the 13th CJI of India appointed in January 1971, was the first lawyer to be elevated directly to the SC bench in March 1964. Appointed as the 49th Chief Justice of India, seniormost judge of the Supreme Court Justice Uday Umesh Lalit studied at the Government Law College in Mumbai and specialised in criminal law. He has been part of several landmark judgments, including the one which held the practice of divorce through instant ‘triple talaq’ among Muslims illegal and unconstitutional. He will succeed incumbent CJI NV Ramana . He will take the oath of office on August 27 and will retire on November 8. His tenure as the CJI will last only 74 days. ‘Most Important Ingredient for Sexual Assault is Sexual Intent’: SC Quashes Bombay HC’s ‘Skin-to-Skin’ Order

The Supreme Court on Thursday quashed the Bombay High Court’s verdict which had held that no offence of sexual assault under the POCSO Act is made out if there is no direct skin-to-skin’ contact between accused and the victim. A Bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi held that the ingredient of the offence of ‘sexual assault’ under POCSO is sexual intent and skin to skin contact in such incidents is not relevant. The law has to be given an interpretation that gives effect to the intention of legislature instead of defeating it, the Court underscored. “The most important ingredient for constituting the offence of sexual assault is sexual intent and not skin to skin contact with the child. Construction of a rule should give effect to rule rather than destroying it. The intention of legislature cannot be given effect to unless wider interpretation is given,” the Court said.
