Supreme Court argument has taken place in United States v. Texas, a high-stakes, hotly contested case on the Administration’s executive programs that deferred possible deportation of millions of undocumented individuals. The Court’s expected June decision is likely to have far-reaching implications for employers.In 2012, the Obama Administration introduced through executive action Deferred Action for Childhood Arrivals (DACA), a program which deferred deportation of certain individuals who arrived to the United States unlawfully as minors. DACA allowed these individuals access to employment authorization. Supreme Court Starts Doing What It Preaches; But Much More Needs To Be Done
Supreme Court of India (SC) recently asked the union government to finalize the Memorandum of Procedure (MoP) for the appointments and transfers in the higher judiciary. Since the Supreme Court’s National Judicial Appointments Commission (NJAC) decision of October, 2015 talks of finalization of new MoP are going on; but union government is insisting on ‘national security clause’. According to the union government, it must have the power to reject any name for appointment in the higher judiciary for reasons of ‘national security’. This would be like giving ‘veto’ to the union government to reject any name recommended by the SC’s collegium. The SC opposed this clause as it is of the view that under the garb of ‘national security’ independence of judiciary might be jeopardized. Pak SC upholds setting up of military courts to try civilians; says vires of constitutional amendment can be examined
A 17 judge bench of the Supreme Court of Pakistan (SC) on Wednesday by majority of 11 against 6 upheld the 21st amendment to the Constitution of Pakistan providing for the establishment of military courts in Pakistan. The Court by a comprehensive majority of 14 against 3 also dismissed petitions challenging the 18th amendment to the Constitution. Supreme Court warns the States of Contempt for Non-implementation of POCSO, RTE and NCPCR ACTs
Supreme Court has said that in spite of the emphatic directions that have been issued by it on 3rd January, 2013 directing all the States and the Union Territories to implement the protective provisions contained in the Protection of Rights of Children from Sexual Offences Act, 2012, the Right of Children to Free and Compulsory Education Act, 2009 and the Commission for Protection of Child Rights Act, 2005, many States and Union Territories have not complied with the same.By order dated 7th February, 2013, Supreme Court had issued further directions to all the States and the Union Territories to comply with the obligations under the aforesaid three Acts, with regard to the establishment of protection institutions/implementation institutions, together with necessary Rules and Regulations.
