The review petitions rely heavily on the dissenting judgment of Justice Indu Malhotra to contend that constitutional parameters of rationality cannot be blindly applied to matters of faith. The review petitions also state that the Court erred in entertaining the PIL without examining the locus standi of the petitioner. It is contended that no woman devotee of Lord Ayyappa would want to visit Sabarimala temple, and hence the Court erred in adjudicating the issue on a petition filed by a party who is totally alien to the temple customs. In doing so, a full bench comprising Chief Justice Hrishikesh Roy, Justice AM Shaffique and Justice AK Jayasankaran Nambiar overruled the division bench judgment in Antony v. P.S. Rana. The court had, in Antony v. PS Rana, ruled that the power of review cannot be exercised by the high court in contempt jurisdiction, as no such power is conferred under the Contempt of Courts Act, 1971. It was further held that if the contempt jurisdiction is invoked in exercise of plenary powers under Article 215 of the Indian Constitution and an order was passed, such an order cannot be withdrawn or reviewed by using the same plenary powers. The bill was unanimously passed, in view of the long standing demand by the Maratha community. At present, Maharashtra has 52% reservation, and the Maratha quota has taken it to 68%. The caveat petition filed through Advocate Nishant R Katneswarkar has prayed that no order be passed in any petition concerning the Maratha legislation, without hearing state government. SC Constitution Bench To Hear Sabarimala Review Petitions On 6th February
By: Ashok Kini 2019-01-31T16:54:42+05:30 The Constitution bench of the Supreme Court will hear review petitions filed in Sabarimala case on 6th February, 2019, the registry has notified today. On November 13 last year, a bench of Chief Justice Gogoi and Justices R. F. Nariman, A. M. Khanwilkar, D. Y. Chandrachud and Indu Malhotra, while refraining from staying the impugned decision, had agreed to hear the nearly 40 review petitions in open Court on January 22nd. But the constitution bench did not sit as one of the judges, Justice Indu Malhotra was on Medical leave. Chief Justice Ranjan Gogoi had also turned down the request for an immediate hearing on the many pleas seeking a review of the 2018 verdict of the Supreme Court five-judge bench in the Sabarimala Temple entry case. Sabarimala : Women Seek To Intervene In Review Petitions In Support Of SC Judgment
By: Live Law News Network 5 Feb 2019 10:12 AM GMT As the Supreme Court Constitution Bench is set to hear the review petitions against Sabarimala judgment tomorrow, four women filed applications today, seeking to intervene in support of the judgment. Two of the applicants- Bindu and Kanaka Durga- had entered the temple on January 2. Bindu, who teaches law at Kannur University School of Legal Studies, says that she has intense desire to pay her respects to "Dharma Shastha", who is worshipped as Lord Ayyappa. Kanaka Durga, who says that she is a believer of all Hindu gods, narrates in detail the discriminatory practises she had to face during menstrual period, such as isolating her in another room, not permitting her to touch the well or draw water from it etc. The petition narrates their attempt to enter temple on December 24, which got foiled due to protests.
