Gavin Newsom on Wednesday nominated Patricia Guerrero to be the state's next chief justice, picking the daughter of Mexican immigrants to lead the nation's largest judicial system. Guerrero, 50, would replace Chief Justice Tani Cantil-Sakauye, who will step down once her term ends in January. Guerrero made history earlier this year when she was the first Latina confirmed to the California Supreme Court. Now she's poised to do it again as the first Latina to lead the state's sprawling court system that includes about 2,175 judges across 58 trial courts and 105 justices on the Courts of Appeal. “Justice Guerrero has established herself as a widely respected jurist with a formidable intellect and command of the law and deep commitment to equal justice and public service,” Newsom said in a news release announcing Guerrero’s nomination. August 10, 2022 by www.thehindu.com

The Supreme Court on Wednesday transferred FIRs registered against former BJP spokeswoman Nupur Sharma in the Prophet remarks row to the Delhi Police. The Delhi Police would also investigate in case any FIRs are registered in the future against Ms. Sharma, the court said. A Special Bench of Justices Surya Kant and J.B. Pardiwala gave Ms. Sharma liberty to approach the Delhi High Court seeking to quash the cases against her. The court refused a suggestion made by West Bengal counsel and senior advocate Menaka Guruswamy for a joint special investigation team to probe the case under the supervision of the apex court. The Bench said an FIR has been filed against Ms. Sharma in Delhi with the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police, and this specialised branch could carry on the probe in all the FIRs. The IFSO could collect information necessary for its investigation from other states. The Bench extended the protection granted to Ms. Sharma on … [Read more...] about Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court

August 10, 2022 by www.newsweek.com

Live Updates Former President Donald Trump has arrived in New York where he has agreed—along with his children Donald Jr. and Ivanka—to testify in a probe into his family business. Attorney General Letitia James has said investigators had uncovered evidence that the Trump Organization overstated asset values to get favorable loans and understated the values for tax breaks. The Trumps deny wrongdoing. In a social media post on Tuesday, Trump again called the probe a "witch hunt," while accusing James, who is Black, of being "racist." Fallout from the FBI's raid on Trump's family home Mar-a-Lago continues, with Eric Trump insisting that President Biden "absolutely signed off" the move. On Wednesday, the former President suggested FBI agents might have been "planting" evidence in his safe. Fair trial goes beyond courts, to the police and media

August 10, 2022 by www.thehindu.com

Recently, the Chief Justice of India objected to the lack of media accountability in the media’s coverage of legal issues. His remarks came less than a month after the Delhi police admitted to informing the media about the outcome of AltNews’ co-founder Mohammed Zubair ’s bail hearing before the judicial order was even pronounced in open court. While the matter of how this information was known to the police remains an open issue, it is problematic that a considerable portion of its news coverage depicted the remarks of the police officer as fact without waiting for the judicial order. The police as source In criminal cases that attract the most sensationalist media coverage, media attention is often drawn toward investigation and early trial stages, with a notable disconnect from eventual outcomes of trial that follow several months or even years after an arrest. This makes the police a crucial source for the media and communication between the two institutions is often a … [Read more...] about Fair trial goes beyond courts, to the police and media

Chinese Court Rejects Appeal in Landmark #MeToo Case

August 10, 2022 by www.news18.com

A Chinese court rejected an appeal in a landmark sexual harassment case on Wednesday, dealing a blow to the country’s fledgling #MeToo movement. Zhou Xiaoxuan stepped forward in 2018 to accuse popular state TV host Zhu Jun of forcibly kissing and groping her during her 2014 internship at the broadcaster. Her case inspired many others to share their experiences of sexual assault publicly and sparked a social media storm. But a court ruled last year that there was not enough evidence to prove Zhou was sexually harassed by Zhu, and her appeal was rejected Wednesday on similar grounds. In a statement, the Beijing No. 1 Intermediate People’s Court said it “will uphold the previous judgment”. Police cordoned off long stretches of pavement outside the court ahead of Zhou arrival in the afternoon, with officers logging the details of passers-by. “The process of the first trial was a deep secondary injury,” she told AFP ahead of her hearing. Zhou, 29, told AFP before returning to … [Read more...] about Chinese Court Rejects Appeal in Landmark #MeToo Case

New Research Says Children’s Health Can be Impacted As Global Temperatures Rise

August 10, 2022 by www.news18.com

Youngsters are likely to suffer the brunt of the worsening health effects of rising global temperatures due to record levels of obesity and physical inactivity, a new comprehensive analysis of recent studies on the topic gave a clear warning. The research led by Dr Shawnda Morrison, an environmental exercise physiologist, argues that while physical fitness is key to tolerating higher temperatures, children are more obese and less fit than ever before and her findings were published in the peer-reviewed journal Temperature. This could put them at greater risk of suffering heat-related health problems, such as dehydration, heat cramps, heat exhaustion or heat stroke. She says that current climate change policies fail to adequately address child health needs and that encouraging children to make exercise part of their everyday lives must be prioritised if they are to cope with living in a hotter world. From Slovenia’s University of Ljubljana, Faculty of Sport, Dr Morrison is an … [Read more...] about New Research Says Children’s Health Can be Impacted As Global Temperatures Rise

They made it through foster care. Now they’re persuading this Bay Area county to pay it backward

July 14, 2022 by www.sfchronicle.com

This is a carousel. Use Next and Previous buttons to navigate 3 Xochtil Larios walked into the Oakland apartment last year and breathed a sigh of relief inside her first stable home in a decade. For Larios, who was removed from a volatile home at age 12, the previous nine years were spent trying to get a foothold as she careened between foster homes, homeless shelters and, occasionally, juvenile hall. Aged out of receiving government services when she turned 21, Larios felt lucky to get a subsidized apartment in one of the least affordable regions in the U.S. “That feeling of having a place of your own, that’s something I’ll never forget,” Larios, now 22, recalled. “It almost seemed unreal, like I was in a dream. To have my own home — to feel safe and have a permanent roof over my head — I cried happy tears.” To help other young adults who face a service cliff as they age out of the foster care system, Larios and a team of 11 former foster … [Read more...] about They made it through foster care. NHS gender clinic, the Tavistock Centre, could face legal action over alleged ‘failings in care’

August 11, 2022 by news.sky.com

The NHS Trust responsible for the UK's only gender-identity clinic for children may face legal action over claims it "rushed" some young patients into treatment, including the use of puberty-blocking drugs. NHS England has already ordered the Tavistock and Portman NHS Foundation Trust to wind-down operations at the Tavistock Centre, also known as the Gender Identity Development Service (GIDS), after an independent review found it was not a "safe or viable long-term option". But now a UK-based law firm is pursuing a group claim for clinical negligence against the Trust, amidst allegations the service "misdiagnosed" some young patients who were struggling with their gender identity. Speaking to Sky News, Tom Goodhead, Global Managing Partner at Pogust Goodhead said: "We believe that there are potentially hundreds of young adults who have been affected by failings in care over the past decade at the Tavistock Centre, and we want to be able to give them a voice in court." He … [Read more...] about NHS gender clinic, the Tavistock Centre, could face legal action over alleged ‘failings in care’
