Politics Vietnam ‘vitally important’ in Indo-Pacific strategy: US ambassador Simplicity of life in Vietnam

· December 10, 2018 ·

Vietnam plays a “central” and “vitally important” part in the Indo-Pacific strategy of the U.S. while Hanoi’s success is Washington’s national interest, Ambassador Daniel Kritenbrink said at a dialogue in Ho Chi Minh City last week. “President Trump chose the APEC CEO Summit in Da Nang last year to deliver America’s vision for a free and open Indo-Pacific because Vietnam represents one of the United States’ most important bilateral partnerships,” Ambassador Kritenbrink said on Friday.  “Vietnam's success is America’s national interest.” Under the Trump administration, Washington favors a free and open Indo-Pacific where the U.S. and its allies will deploy more resources amid China’s growing dominance. Vietnam plays a “central, vitally important” part in this strategy, Kritenbrink told Tuoi Tre News at the Indo-Pacific Dialogue – Vietnam 2018. He quoted a World Bank report … [Read more...] about Politics Vietnam ‘vitally important’ in Indo-Pacific strategy: US ambassador Simplicity of life in Vietnam

You Are Nation’s Conscience Keepers: Justice Chelameswar At NUALS Convocation Ceremony [Full Text Of Convocation Address]

· January 17, 2017 ·

Hon’ble Chancellor, Vice-Chancellor, distinguished personalities on and off the dais, members of the faculty, the stars of today’s celebration—young graduates—ladies and gentlemen:My association with this scenic state, God’s Own Country, has begun almost a decade ago. And it continues. I always look forward to being here on one occasion or another: this place with its pristine pleasures of nature always rejuvenates. Here the people’s simplicity humbles me, their affection engulfs me, their learning challenges, their commitment inspires, their dedication goads me to view the world in a different light—a better and brighter light. No wonder, I am delighted once again to be before you; more particularly amid the bright and brilliant future architects of this nation, you, the graduates. My delight has a person angle, too, for I was once the Chancellor of this Seat of Learning.Everything changes and nothing remains constant. Perhaps change alone is … [Read more...] about You Are Nation’s Conscience Keepers: Justice Chelameswar At NUALS Convocation Ceremony [Full Text Of Convocation Address]

Divided Fourth Circuit Panel Rules On Burden of Proving Loss Causation in ERISA Fiduciary Breach Case

· August 19, 2014 ·

“As for those who might contemplate future service as plan fiduciaries, all I can say is: Good luck.” That was the sentiment expressed in a blistering dissent by Fourth Circuit Judge J. Harvie Wilkinson in the latest ruling in a lawsuit challenging the decision by the fiduicaries of the RJR 401(k) plan to liquidate two stock funds that previously had been available to plan participants wishing to invest in Nabisco stock.  In a split decision, the panel ruled that, because plaintiff-participant Richard Tatum had proved that the plan fiduciaries acted imprudently by liquidating the stock fund without the benefit of a proper investigation, the burden of proof shifted to defendants to show that a prudent fiduciary would have made the same decision.  In so ruling, the Court reversed the lower court decision, which had found in favor of defendants after a bench trial upon finding that they had demonstrated that a prudent fiduciary could have … [Read more...] about Divided Fourth Circuit Panel Rules On Burden of Proving Loss Causation in ERISA Fiduciary Breach Case

Agreement Reached on Form of New EU Securitisation Regulation and on Amendments to the Capital Requirements Regulation

· June 26, 2017 ·

IntroductionThe EU legislative institutions have now agreed compromise amendments to the proposed EU regulation intended to lay down common rules on securitisation and to create a European framework for “simple, transparent and standardised” (“STS”) securitisation (the “Securitisation Regulation”)[1]. They have also agreed compromise amendments to the proposed regulation amending the Capital Requirements Regulation[2] (the “CRR”), which includes a new hierarchy of approaches for calculating exposures to securitisation transactions and provisions designed to result in the regulatory capital requirements for exposures to STS securitisations being lower than those for non-STS securitisations (the “CRR Amendment Regulation”)[3] (together, the “Regulations”). This memorandum is written on the basis of our understanding of these agreed compromises.OverviewSince the initial proposals were published nearly two years ago, … [Read more...] about Agreement Reached on Form of New EU Securitisation Regulation and on Amendments to the Capital Requirements Regulation

Thirty Things I’ve Learned After 30 Years as Estate Planner

· June 6, 2017 ·

I began practicing estate planning in the spring of 1987. I had been out of law school for less than a year, practicing in litigation at a large, prestigious firm in Chicago, meaning that I largely spent my days looking at documents in cases in which one faceless corporation was suing another. As I remember the story (facts do get fuzzy over time), a partner came to me and said that he had a small piece of probate litigation that he didn't want to be bothered with. I think the case revolved around whether life insurance proceeds needed to be paid because there was a suspicion that the decedent had committed suicide. I don't remember the result but I do remember that I was intrigued that the practice of law actually involved living, breathing (or dead!) human beings and human emotion, something I had not encountered as a commercial litigation associate before that. I spoke with a couple of the partners in the firm's Trusts and Estates Group and asked if I could do some work with them … [Read more...] about Thirty Things I’ve Learned After 30 Years as Estate Planner
