Should gay marriage be legal

Clarence Thomas wants SCOTUS to “correct the error” of legal gay marriage

June 24, 2022 by www.newsweek.com

Supreme Court Associate Justice Clarence Thomas argued in a Friday opinion that the nation's top judicial body should overrule a previous decision legalizing LGBTQ marriage nationwide and a former ruling that determined criminalizing sodomy is unconstitutional. Thomas issued a concurring opinion with the Supreme Court 's 5 to 4 decision overturning abortion rights as established by Roe v. Wade on Friday. The conservative justice, who was appointed by former Republican President George H.W. Bush , took aim at the Court's 2003 ruling in Lawrence v. Texas and its 2015 decision in Obergefell v. Hodges . Lawrence established that criminal penalties for sodomy or private sexual acts between consenting adults are unconstitutional. That decision came down in a 6 to 3 ruling. Obergefell legalized same-sex marriage nationwide in a 5 to 4 decision. Thomas, who joined the court in 1991, dissented in both the 2003 and 2015 Supreme Court decisions. In his Friday concurring … [Read more...] about Clarence Thomas wants SCOTUS to “correct the error” of legal gay marriage

Fact Check: Clarence Thomas and ‘Substantive Due Process’

June 24, 2022 by www.breitbart.com

CLAIM: Justice Clarence Thomas says the Supreme Court will reverse other socially liberal decisions after overturning Roe . VERDICT: MOSTLY FALSE. Thomas wants to end “substantive due process,” but agrees Dobbs only applies to abortion. The long-awaited decision in Dobbs v. Jackson Women’s Health Organization was handed down by the Supreme Court on Friday, and it overturned Roe v. Wade (1973), which had provided a constitutional right to abortion. As Breitbart News has explained, the Dobbs decision is limited to abortion, and would not affect other socially liberal decisions on contraception, gay marriage, and so on — despite what Democratic Party leaders have been saying in an effort to raise the alarm on Dobbs . But a concurring opinion issued by Justice Thomas has set the chattering classes on edge again, repeating past warnings. The widespread assumption was that the Court wouldn’t ever *really* overturn Roe. Clearly that was wrong. The Court’s senior … [Read more...] about Fact Check: Clarence Thomas and ‘Substantive Due Process’

Supreme Court overturns Roe v. Wade, allowing states to ban abortions

June 24, 2022 by www.denverpost.com

The Supreme Court has ended the nation’s constitutional protections for abortion that had been in place nearly 50 years in a decision by its conservative majority to overturn Roe v. Wade. Friday’s outcome is expected to lead to abortion bans in roughly half the states. The decision, unthinkable just a few years ago, was the culmination of decades of efforts by abortion opponents, made possible by an emboldened right side of the court that has been fortified by three appointees of former President Donald Trump. Both sides predicted the fight over abortion would continue, in state capitals and in Washington, and Justice Clarence Thomas, part of Friday’s majority, called on the court to overturn other high court rulings protecting same-sex marriage, gay sex and the use of contraceptives.
