Cautionary Ruling for Website Accessibility: Gil v. Winn-Dixie Stores

· June 27, 2017 ·

Websites may constitute “public accommodations” under the Americans with Disabilities Act (ADA), according to one court. On June 12, 2017, in a case of first impression, a federal district court in Gil v. Winn-Dixie Stores Inc. held that a website that is heavily integrated with physical store locations and operates as “a gateway to the physical store locations” constitutes a service of a public accommodation covered by the ADA.[1]  This decision comes in the midst of a trend, as we have previously reported, of increasing legal challenges to businesses on the theory that their websites are allegedly inaccessible to disabled persons, in violation of Title III of the ADA.  Although the Gil v. Winn-Dixie decision is not binding on courts in other jurisdictions, other courts may consider it and find it persuasive.  Businesses with consumer-facing websites should make web accessibility a priority. The Gil v. … [Read more...] about Cautionary Ruling for Website Accessibility: Gil v. Old-line Kroger shows new moves in grocery delivery drive

· August 7, 2018 ·

By Lisa Baertlein CINCINNATI (Reuters) - Kroger Co <KR.N>, the nation's biggest supermarket chain, whose founder delivered groceries by horse and buggy, is using a different kind of horsepower in its race with online grocery sellers. The 135-year-old company is experimenting with a variety of technologies as it battles Amazon.com <AMZN.O> and Walmart Inc <WMT.N> to find a profitable formula to serve customers who want milk and eggs whisked to their doorsteps. These shoppers are a tiny but fast-growing segment of the $800-billion U.S. grocery market. Kroger must win them over to survive. "We want to serve the customer on their terms," said Chief Executive Rodney McMullen, who for years has kept tabs on the economics of grocery delivery. "For us, every penny counts." In a series of interviews with Reuters at Kroger headquarters in Cincinnati, McMullen and other executives outlined a host of experiments and initiatives. These include self-driving delivery vans, … [Read more...] about Old-line Kroger shows new moves in grocery delivery drive

Amazon to Close All Its Pop-Up Shops

· March 5, 2019 ·

Amazon said Wednesday that it will shut down all its pop-up shops and focus on opening more of its bookstores as it rethinks its brick-and-mortar strategy. The online retail giant has 87 pop-up shops in malls, Whole Foods grocery stores and Kohl's department stores that sell Amazon's Echo voice-activated devices, Kindle tablets and other gadgets. Amazon did not say when the pop-up shops would shut down, but the Wall Street Journal, citing anonymous sources, reported that they will shutter at the end of April. The news comes a day after Kohl's said it was moving away from having Amazon shops in its stores and instead plans to sell Amazon gadgets in a designated section. Amazon has been making a big push into brick-and-mortar stores, buying up the Whole Foods grocery chain, opening 19 bookstores and 10 cashier-less convenience stores around the country. But sales at its physical stores slipped 3 percent in the last three months of 2018, compared with the same period the year before. … [Read more...] about Amazon to Close All Its Pop-Up Shops
