Two Recent Delaware Decisions Further Illustrate Scope of Section 220 Discovery
Two recent Delaware Court of Chancery decisions demonstrate that narrow statutory standards continue to govern access to corporate books and records pursuant to Section 220 of the Delaware General Corporation Law. In the wake of Wal-Mart Stores, Inc. v. Indiana Electrical Workers Pension Trust Fund IBEW, 95 A.3d 1264 (Del. 2014), legitimate questions existed regarding whether the Delaware Supreme Court’s decision might usher in an era of expansive Section 220 discovery. SC Acquits 17 Accused In 1990 Murder Case [Read Judgment]
One of them, Ayub Khan, has already served 11 years in jail. The Supreme Court has acquitted 17 persons in a murder case of the year 1990.This judgment by the Supreme Court illustrates the oft-quoted proverb: Justice delayed is Justice denied. Ayub Khan is one of the accused in the murder case.Though the trial court acquitted him and the other 16 accused, the high court reversed those findings and sentenced all of them to life imprisonment. During the pendency of his appeal before the apex court, which now acquitted him, he lost his precious 11 years in jail.The Supreme Court, setting aside the high court judgment, observed that the trial court’s judgment was more than just a possible view for arriving at the conclusion of acquittal, and that it would not be safe to convict 17 persons accused of the crime of murder i.e., under Section 302 read with Section 149 of the Indian Penal Code. New lawyer Scott Neal is among the lucky law grads who have landed a law firm job.But his position at the firm in Birmingham, Mich., is only part-time. He also works as a building supervisor at the YMCA and as a tree trimmer, the Detroit Free Press reports in a story reprinted by USA Today. The story asks the question: Is part-time work the new normal?“My parents are pressuring me to get a full-time job, even if it’s not in law,” says Neal, who lives with his parents.Nearly 1 million new jobs were created this year, but 80 percent of the positions were part-time, the story says. Involuntary part-time workers who are looking for full-time work or working multiple jobs make up more than 19 percent of the workforce, up from 17 percent in 2007.Derrick George is the lawyer who hired Neal. · SGR Fix Advances in the House, Action Planned in Senate: On Friday, the House voted 238 to 181 to approve H. Res. 515, legislation that would repeal the SGR and pay for it by delaying the individual mandate requirement of the Affordable Care Act (ACA) for five years. In advance of the SGR movement that occurred in both chambers, the Congressional Budget Office (CBO) released a new estimate finding that suspending the individual mandate until 2019 would save $169.5 billion- thus more than paying for an SGR replacement currently estimated at $138 over 11 years. Although the House measure will not likely gain traction in the Senate and the President has promised a veto of the measure, Majority Leader Harry Reid (D-NV) placed S. 2110, an SGR repeal that also includes Medicare extenders but is not paid for, on the Senate calendar for consideration late in March.
