For employers with California employees, there seems to be no way to avoid California’s complicated and protective employment laws, and things just got a bit more complicated.On September 25, 2016, Governor Brown signed into law SB 1241, which prohibits employers from requiring California employees to litigate or arbitrate employment disputes outside of California or under the laws of another state.SB 1241 applies to any contract entered into, modified, or extended on or after January 1, 2017. The new law prohibits so called “choice of law” and “forum selection” clauses that require employees who live and work in California to bring their employment claims in jurisdictions other than California or under the laws of another state. Existing California law provides that parties to an employment contract may select the state law governing their agreements, including the venue to litigate disputes.The common practice of using forum selection clauses and choice-of-law provisions regarded as more favorable to employers evolved out of California’s prohibition on non-compete clauses under California Business & Professions Code Section 16600. In the past two years, virtually every city and school district in the South Bay has moved elections to in order to comply with SB 415, a state law that aims to boost dwindling voter turnout in local elections by having them take place on the same day as statewide races that bring out a bigger crowd. Just try working with such state agencies as the Tahoe Regional Planning Agency and the state Coastal Commission sometime. State-mandated high-density housing next to already-impacted transit isn’t logical. Mandating a $400,000 home in Blackhawk because it’s not fair that I can’t afford to live there is ridiculous.
