Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court

August 10, 2022 by www.thehindu.com

The Supreme Court on Wednesday transferred FIRs registered against former BJP spokeswoman Nupur Sharma in the Prophet remarks row to the Delhi Police. The Delhi Police would also investigate in case any FIRs are registered in the future against Ms. Sharma, the court said. A Special Bench of Justices Surya Kant and J.B. Pardiwala gave Ms. Sharma liberty to approach the Delhi High Court seeking to quash the cases against her. The court refused a suggestion made by West Bengal counsel and senior advocate Menaka Guruswamy for a joint special investigation team to probe the case under the supervision of the apex court. The Bench said an FIR has been filed against Ms. Sharma in Delhi with the Intelligence Fusion and Strategic Operations (IFSO) unit of the Delhi Police, and this specialised branch could carry on the probe in all the FIRs. The IFSO could collect information necessary for its investigation from other states. The Bench extended the protection granted to Ms. Sharma on … [Read more...] about Delhi Police to investigate all FIRs against Nupur Sharma: Supreme Court

Attorney General Letitia James has said investigators had uncovered evidence that the Trump Organization overstated asset values to get favorable loans and understated the values for tax breaks. The Trumps deny wrongdoing. In a social media post on Tuesday, Trump again called the probe a "witch hunt," while accusing James, who is Black, of being "racist." Fallout from the FBI's raid on Trump's family home Mar-a-Lago continues, with Eric Trump insisting that President Biden "absolutely signed off" the move. On Wednesday, the former President suggested FBI agents might have been "planting" evidence in his safe. (AP) — Former Miss America Cara Mund said Wednesday that her concern about the erosion of abortion rights prompted her independent bid for the U.S. House in her home state of North Dakota. Mund, who is running against the odds in deeply conservative North Dakota, told The Associated Press that the U.S. Supreme Court’s ruling to overturn the constitutional right to abortion was “just a moment where I knew we need more women in office.” The 28-year-old recent Harvard Law School graduate announced her candidacy Saturday, just weeks before early voting begins in the state where Republicans hold every statewide office. Her run comes as North Dakota’s only abortion clinic is Fargo prepares to relocate across the border to Minnesota to avoid recrimination if courts allow a law banning all abortions except in cases of rape, incest or to protect the life of the pregnant … [Read more...] about Ex-Miss America Mund: Abortion ruling prompted US House run

‘Most Important Ingredient for Sexual Assault is Sexual Intent’: SC Quashes Bombay HC’s ‘Skin-to-Skin’ Order

November 18, 2021 by www.news18.com

The Supreme Court on Thursday quashed the Bombay High Court’s verdict which had held that no offence of sexual assault under the POCSO Act is made out if there is no direct skin-to-skin’ contact between accused and the victim. A Bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi held that the ingredient of the offence of ‘sexual assault’ under POCSO is sexual intent and skin to skin contact in such incidents is not relevant. The law has to be given an interpretation that gives effect to the intention of legislature instead of defeating it, the Court underscored. “The most important ingredient for constituting the offence of sexual assault is sexual intent and not skin to skin contact with the child. Construction of a rule should give effect to rule rather than destroying it. The intention of legislature cannot be given effect to unless wider interpretation is given,” the Court said. Mandating “skin to skin” contact would amount to a narrow and absurd interpretation, … [Read more...] about ‘Most Important Ingredient for Sexual Assault is Sexual Intent’: SC Quashes Bombay HC’s ‘Skin-to-Skin’ Order

I solved the mystery: here’s why Trump wasn’t just subpoenaed | Opinion

August 10, 2022 by www.newsweek.com

I know why former President Donald Trump 's papers were seized in a search, rather than obtained via subpoena. It was to circumvent his Fifth Amendment rights. If Trump were subpoenaed to turn over material that may be classified, his lawyers would have the right to claim that the very act of producing these documents would be incriminating. It would constitute an admission that he possessed these contraband documents. This is a common problem in criminal investigations. The Justice Department generally solves the problem by offering the suspect "production immunity." This is a rather complex constitutional mechanism, but it is one that is frequently used. If a defendant is given production immunity, he must turn over the incriminating documents, but the government is precluded from using the fact that it was he who turned them over. The government remains free to introduce the documents for their substantive content—but the government cannot say whence it obtained them, and it … [Read more...] about I solved the mystery: here’s why Trump wasn’t just subpoenaed | Opinion

Ayodhya Hearing Deferred Till Jan 29 as Justice UU Lalit Recuses Self After Muslim Petitioners Object

January 10, 2019 by www.news18.com

New Delhi: The Supreme Court on Thursday deferred the hearing in the Ayodhya title dispute case to January 29 after Justice UU Lalit, who was part of a Constitution bench to hear the case, recused himself on Thursday. Justice Lalit appeared for former Uttar Pradesh chief minister Kalyan Singh in 1994, senior advocate Rajeev Dhavan — who was appearing for the Muslim petitioners — told the bench headed by Chief Justice Ranjan Gogoi soon after the court assembled. Though Dhavan said he was not seeking Justice Lalit's recusal, the judge opted out of the hearing in the matter. The bench, also comprising Justices SA Bobde, NV Ramana and DY Chandrachud, noted the submissions made by Dhavan. Dhavan also drew the attention of the bench to the fact that the matter was earlier fixed for hearing before a three-judge bench but the CJI took a decision to list it before a five-judge Constitution Bench. He further submitted that there was need for a judicial order to set up a five-judge … [Read more...] about Ayodhya Hearing Deferred Till Jan 29 as Justice UU Lalit Recuses Self After Muslim Petitioners Object

In Guam, the nearest domestic abortion clinic is 4,000 miles away. How will Roe’s reversal change the U.S. territory?

August 10, 2022 by www.nbcnews.com

The Supreme Court’s decision to overturn Roe v. Wade, which had made abortion a constitutionally protected right, could have a chilling effect on reproductive rights in Guam. Advocates say women have already been living under a de facto ban in the largely Catholic U.S. Pacific Island territory and fear it could get more restrictive. No surgical abortion has been performed on the island since 2018, when the last doctor trained to provide the procedure retired, according to the ACLU and the Bureau of Women’s Affairs. “People in Guam were already living in a post-Roe world,” Alexa Kolbi-Molinas, deputy director of the American Civil Liberties Union’s Reproductive Freedom Project, told NBC Asian America. “This is what we will see again if extremist politicians enact new abortion bans and force women into second-class status.” The Supreme Court ruling might have ramifications for Pacific Islanders in the two other U.S. Pacific territories, the Northern Mariana Islands and … [Read more...] about In Guam, the nearest domestic abortion clinic is 4,000 miles away. Cancellation of Atlanta festival sparks new fight over guns

August 10, 2022 by www.sfgate.com

This is a carousel. Use Next and Previous buttons to navigate 3 ATLANTA (AP) — Tens of thousands of Music Midtown festivalgoers are no longer going to descend on Atlanta’s massive Piedmont Park next month to cheer on hip-hop star Future or watch beloved rock band My Chemical Romance take the stage. In fact, some people are convinced Atlanta — center of the nation’s hip-hop music scene — will lose more music festivals and performances on public land as organizers and artists learn that state law makes it nearly impossible for them to stop people from carrying guns among the alcohol-fueled crowds. That prospect has ignited a new fight over gun rights in Georgia that is roiling the governor’s race, casting a shadow over Atlanta’s vaunted music scene and adding to tension between the city and state. Live Nation has refused to say why it recently called off September’s Music Midtown, a longtime fixture for pop music lovers.
