‘Sociological Gobbledygook’: Justice Roberts Apparently Not Buying Dems’ Claim in Gerrymandering Case
The Supreme Court has heard this question before, but their decision left so much unclear. In 2004’s Vieth v. Jubelirer, justices didn’t even settle on a majority. A four-member plurality led by the late Antonin Scalia agreed that courts shouldn’t be involved in this sort of redistricting matter. A fifth justice, Anthony Kennedy, partially agreed in his concurring opinion. He argued there remained no good way to measure if a district was truly drawn in an overly political, unconstitutional way.
