Examine Measures For Rehabilitation Of Women Prisoners And Their Children: SC To Amicus Curiae [Read Order]

The Supreme Court, last week, directed amicus curiae Advocate Gaurav Agarwal to examine the issue of rehabilitation and welfare of women prisoners and their children, on a suo motu petition initiated by the Court in 2013. The Bench comprising Justice M.B. Lokur, Justice Kurian Joseph and Justice Deepak Gupta also directed Mr Surinder Rathi, Director of National Legal Services Authority of India (NALSA) to look into the issue of overcrowding of jails. Mr Rathi has further been directed to furnish figures on the population of jails where the occupancy is more than 150% as on 31 December 2017, as well as coordinate with the Member Secretaries of the State Legal Services Authorities to ascertain the number of vacant posts in major jails across the country. The suo motu Petition before the Court had been triggered by a letter written to the then Chief Justice of India by former CJI R.C. The Supreme Court has asked Shri Mata Vaishno Devi Shrine Board to look into the matter of rehabilitation of mule owners in a humanitarian manner. A bench of Justice Madan B Lokur and Justice Deepak Gupta observed thus as it was told by the ASG representing State of Jammu and Kashmir that a plan has been made for rehabilitation of Mule owners operating on the track between Katra town to Shri Mata Vaishno Devi Ji Shrine and that the Shrine Board declined to part with any funds for the rehabilitation of Mule owners apparently on the ground that after a new track is inaugurated they do not require the services of the Mule owners. Rehabilitation Homes For Mentally Ill People: SC Seeks Status Report From States And UTs

Ten states and a UT have filed their response on the compliance of the Centre’s guidelines for setting up of rehabilitation homes for persons living with mental illness (who have been cured, or who do not need further hospitalization, or who are homeless or are not accepted by their families). A bench of Justices U U Lalit and D Y Chandrachud which issued fresh notice said that it will go into the merits of the case after all states and UTs have filed their responses in two weeks. Petitioner in-person advocate Gaurav Bansal said that more than 15,000 people are forced to stay with the mentally ill patients. Rehabilitation Of Cured Mental Patients: SC Issues Further Directions [Read Order]

In July 2017, the Supreme Court had issued an order emphasizing the need for setting up rehabilitation homes for persons (i) living with mental illnesses who have been cured; (ii) who do not need further hospitalization; (iii) who are homeless; and (iv) who are not accepted by their familiesThe bench comprising Justice DY Chandrachud and Justice Hemant Gupta were considering Contempt petitions that were initiated on the ground that there was non-compliance by some of the State Governments and the Union Territories.
