GDPR: Everything you need to know about the new data laws

· May 24, 2018 ·

News / UK and world by Press Association May 25, 2018, 5:46 am FacebookTwitterLinkedInWhatsAppEmail Sign up to our Daily newsletter New data laws come into force in Europe today, but how will the General Data Protection Regulation (GDPR) affect businesses and the general public? What is GDPR? The General Data Protection Regulation is a new, EU-wide law that gives greater power to regulators to penalise companies who mishandle personal data or are not transparent about how their business uses it. For consumers, it brings new powers that require firms to obtain clear consent from users before processing their data, as well as grants users a right to easily access the data collected from them and transparency on how it is being used. What are the key aspects of the regulations? As well as those already mentioned, one key element is the increased jurisdiction GDPR gives regulators. Under the new rules, any company that controls or processes the data of EU citizens … [Read more...] about GDPR: Everything you need to know about the new data laws

‘Don’t panic over GDPR’: watchdog tells small businesses

· May 25, 2018 ·

Small businesses shouldn't panic over not being ready for new data protection rules, the information watchdog has said on deadline day. The biggest shake-up surrounding personal information, called General Data Protection Regulation (GDPR), comes into force today. Failure by companies to comply will leave them exposed to heavy fines. Many small businesses have failed to be ready in time - meaning their customers are likely to continue to receive emails asking them about how firms use their data in weeks beyond the deadline. But Elizabeth Denham,  the Information Commissioner, reassured small businesses that they will not be punished for failing to be ready on time. "Small businesses should not... Practical Guidance on the GDPR – Part 4

· September 14, 2017 ·

Here are answers to two more questions arising from next year’s GDPR, this time on website recruitment and data breach notification. More to follow in this series soon. We have a contact form section on our website to allow people to submit details (name, email, phone number & CV) if they want to be informed of future vacancies in our business. Is this allowable under GDPR or should we remove it?The GDPR will not prevent organisations from including such sections on their websites. As the collection and use of such information would amount to “processing” for data protection purposes, however, the employer will clearly be obliged to comply with the new obligations under the GDPR, e.g. providing much more information to individuals about what data is collected, how it will be used, who it will be shared with, etc. Specifically you would also be advised to include on the site information about how the decision will be made (if any such decision is made) to filter … [Read more...] about Practical Guidance on the GDPR – Part 4

EU-U.S. Privacy Shield Rejected, GDPR Approved – What This Means to Automotive Organizations

· April 28, 2016 ·

The European Union Article 29 Working Party (Article 29) issued an opinion on the proposed EU-U.S. Privacy Shield framework agreement (Privacy Shield) earlier this month, stating that although the Privacy Shield was a “great step forward,” the Article 29 group identified several areas in which it found the Privacy Shield to be unacceptable, including that it permits the U.S. to carry out “massive and indiscriminate” bulk surveillance of European Union citizens. On the other hand, just a day later on April 14, 2016, European Parliament provided final approval for the new EU General Data Protection Regulation (GDPR), after four years of work between the member states. While many automakers will be disappointed to learn of the Article 29 group’s rejection of the Privacy Shield, as it does not provide “adequate protection” to EU residents (and European automakers), it should not come as a surprise. The Article 29 group continued to raise concerns … [Read more...] about EU-U.S. Privacy Shield Rejected, GDPR Approved – What This Means to Automotive Organizations

General Data Protection Regulation (GDPR) Publication Starts Countdown to May 2018 Compliance Date for New Privacy Rules

· May 9, 2016 ·

The new General Data Protection Regulation (GDPR) (Regulation 2016/69, Apr. 27, 2016), approved by the European Parliament and the Council of the European Union, was formally published in the Official Journal of the European Union on May 4, 2016, and will replace the Data Protection Directive (Directive 95/46/EC) effective May 28, 2018. This new set of requirements has been a long time coming, but brings a host of new requirements important to companies that use or process data in the EU or simply use or process data about EU citizens anywhere in the world outside the U.S. Unlike a directive, the GDPR does not require enabling legislation by Member States to apply, but Member State action is nonetheless anticipated in areas like updating penalties and defining a “child” for purposes of the Regulation.Among the key requirements created by the GDPR are the following:Companies outside the EU that are targeting EU consumers will be subject to the GDPR.Data controllers will be … [Read more...] about General Data Protection Regulation (GDPR) Publication Starts Countdown to May 2018 Compliance Date for New Privacy Rules
