However, on a closer reading of the judgment, it strikes me that Malhotra J.’s dissent raises some crucial points, which remain unanswered in the opinions of the Chief Justice and Nariman J. – but are addressed in Chandrachud J.’s concurrence. For this reason, I will use this post to discuss the dissenting opinion, and flag its foundational arguments, and then – in the next post – examine Chandrachud J.’s concurrence. Maintainability How unusual – but how refreshing – to see a judge taking maintainability seriously, and that too in a PIL! Malhotra J. starts her analysis with the following observation: The right to move the Supreme Court … [Read more...] about The Sabarimala Judgment – II: Justice Malhotra, Group Autonomy, And Cultural Dissent

POLITICS 09/13/2018 09:24 am ET The Department of Education is embracing a definition of Judaism as both a religion and an ethnicity. Other groups have asked for the same treatment. By Rebecca Klein Over a week after the Department of Education indicated it would start embracing a definition of Judaism as both a religion and an ethnicity, another religious group asked for the same treatment, HuffPost has learned. In late August, the head of the U.S. Department of Education’s Office for Civil Rights (OCR) wrote to the Zionist Organization of America saying that the department would re-open a civil rights complaint filed in 2011 alleging anti-Semitism at Rutgers University. In this letter, the head of OCR, Kenneth Marcus, also said the department would use an expanded definition of what constitutes as anti-Semitism, and indicated it would consider Judaism both a religion and an ethnicity. The controversial move, first reported by The New York Times, has drawn … [Read more...] about Sikh Group To Department Of Education: Treat Our Religion As An Ethnicity, Too
Small, nonconforming religious communities make for fascinating stories, such as the Netflix docuseries "Wild Wild Country," but when media wield the label “cult,” it can lead to unintended but serious consequences, according to Catherine Wessinger, a professor of the history of religions at Loyola University New Orleans.A prime example: 76 members of a religious movement known as the Branch Davidians who died in a government seige in the 1990s. Their deaths were unnecessary, she said, and the media acted as apologists for the government’s actions in the conflict. On Thursday, Wessinger gave a talk entitled “The Cult Narrative and the Branch Davidians,” at UW-Madison, arguing for a more nuanced understanding of religious movements. The talk was a product of a joint effort between the university's Religious Studies Program and School of Journalism and Mass Communication to help journalists better cover religious subjects. It’s the product of a two-year … [Read more...] about With ‘cult narrative’ on the rise, professor argues for nuanced look at religious movements

Jewish Leadership CouncilThe Jewish Leadership Council (JLC) is a charity that acts as an umbrella organisation for the major British Jewish groups. Its members include the Board of Deputies of British Jews, Jewish Care, Liberal Judaism, the Zionist Federation of Great Britain and Ireland, and World Jewish Relief, among others. The heads of each of these groups sits on the JLC's top body. The JLC says this makes it "accountable to all the major institutions of the British Jewish community".The JLC and the Board of Deputies jointly-organised the protest against anti-Semitism in Labour outside Parliament on 26 March and have been highly critical of Jeremy Corbyn's handling of the issue. The Labour leader has offered to urgently meet with the heads of the JLC and Board of Deputies. In reply, they have called … [Read more...] about Labour’s anti-Semitism row: Who are all the different groups?
