The Public Prosecutor rejected all objections or exceptions filed by the attorney of defendant Habib Bahar bin Smith in the case of mistreatment of two teenagers in Bogor District, because the indictment, made as an objection point, was in accordance with the facts. "Refusing the exception or objection note from the defendant's legal counsel," the Public Prosecutor, Suharja, stated at the proceedings with Bahar, in the courtroom of the Bandung Library and Archives Office on Thursday. Suharja noted that there was no mistake in the indictment against Bahar. "Declaring the indictment of the public prosecutor on behalf of Bahar has been clearly and carefully drawn up," the prosecutor remarked. What’s happening? Brussels is reaching a key stage in moves to open a new agency aimed at tackling fraud involving European Union cash. What is it? The European Public Prosecutor’s Office (EPPO), which aims to be up-and-running by next year, seeks to address shortcomings of the EU’s other crime-fighting agencies. There is already the European Anti-Fraud Office (OLAF), which is the only agency that can independently investigate corruption involving EU money. But it can’t bring those it believes are guilty to justice, its powers stop at the border of each member state. Rather than launch a prosecution itself, OLAF is only allowed to recommend national authorities investigate. Between 2009 and 2016 only 44.5% of the agency's judicial recommendations resulted in charges being brought, the rest were dismissed. Once she is convicted post-trial in a non-bailable offence and the sentence awarded is more than 3 years, the accused seeks suspension of the execution of sentence during the pendency of the appeal u/s 389 CrPC. It is, therefore, important to bear in mind that while Section 439 is at the pre-conviction stage, Section 389 is at the post-conviction stage. If anyone is aggrieved by the grant of bail to the accused at the pre-conviction stage, she has two remedies.
