After intense debate for nearly five hours, the Lok Sabha today passed The Constitution (One hundred and twenty-fourth amendment) Bill, 2019 to provide for reservation in public employment and higher education for economically weaker sections. At a voting held at around 10 PM on the last day of the winter session, 323 out of 326 MPs present voted in support of the Bill. The announcement of Speaker Sumitra Mahajan regarding the passing of the bill was greeted by chants of "bharat mata ki jai" by most members. Economic reservation in jobs and education is proposed to be provided by inserting clause(6) in Articles 15 and 16 of the Constitution. As per the Bill, Hindus, Sikhs, Parsis, Jains and Christians who migrate to India without travel documents from Pakistan, Bangladesh and Afghanistan will not be regarded as illegal migrants. This is proposed to be done by inserting a new proviso to Section 2(1)(b) of the Citizenship Act 1955. The present present Citizenship Act does not recognize the claims of illegal migrants for citizenship. To this end, it seeks to amend five Acts: (i) the Divorce Act, 1869, (ii) the Dissolution of Muslim Marriage Act, 1939, (iii) the Special Marriage Act, 1954, (iv) the Hindu Marriage Act, 1955, and (v) the Hindu Adoptions and Maintenance Act, 1956. The Amendment Bill proposes to amend the provisions in these Acts which prescribe leprosy as a ground for divorce or separation from the spouse. The Statement of Objects and Reasons of the Bill acknowledges the medical advances made in the field, thereby making leprosy curable. The Lok Sabha today passed Aadhaar and Other Laws(Amendment) Bill 2018 to modify the existing laws in relation to the use of biometric data for authentication of identity for the purposes of grant of services, benefits and subsidies. The bill was passed with little debate by the house marked with low attendance. The Constitution Bench of the SC in the judgment delivered on September 26 had upheld the constitutional validity of the Aadhaar Act by 4:1 majority, with certain restrictions and changes. The compulsory use of Aadhaar based KYC for mobile connections and bank accounts was prohibited by the SC. The motion to adopt the Bil was supported by 245 members and opposed by 11 members. The Lok Sabha had passed the Triple Talaq Bill in last year’s winter session during December 2017. After the Bill got blocked in Rajya Sabha in the monsoon session, the Government brought in an Ordinance in September 2018.
