Anthony Kennedy: Swing justice wielded quiet power in a range of high-profile cases
In his decades on the court, Anthony Kennedy has crafted a powerful, if hard to define, judicial legacy -- seemingly in the forefront of every major ruling during his tenure. (Associated Press) A low-key California judge seemed the right man at the right time, a perfect antidote for a White House and Congress left angry and exhausted. The Senate confirmation of Anthony Kennedy in 1988 to sit on the Supreme Court ended the long and contentious political process of selecting a successor to Justice Lewis Powell. After two failed nominations, President Ronald Reagan went a familiar route, nominating an old acquaintance from his days as California governor. In his decades on the court since that unusual beginning, Kennedy has crafted a powerful, if hard to define, judicial legacy -- seemingly in the forefront of every major ruling during his tenure. State high court denies Bashara appeal
George Hunter The Detroit News Published 9:42 p.m. UTC May 30, 2018 A terse one-paragraph sentence released Wednesday by the Michigan Supreme Court effectively brings an end to one of the most publicized criminal cases in state history. The state's highest court has declined to hear the appeal for a new trial by former Grosse Pointe Park businessman Bob Bashara, 60, who paid his developmentally disabled handyman Joseph Gentz to kill his wife Jane Bashara on Jan. 24, 2012. Bashara sought a new trial after his December 2014 murder conviction, claiming his attorneys didn't properly represent him. While on the witness stand during his new trial hearing in 2015, Bashara also claimed a "brood of vipers" in the media had tainted his image as a philanthropist who raised money for charity. "He had a fair trial," said Lillian Diallo, who was Bashara's attorney during the murder trial. "It was over and above what's given to most defendants. Justice was fairly meted out in … [Read more...] about State high court denies Bashara appeal
Wisconsin high court backs Ho-Chunk in dispute with quarry, protects burial sites
A Madison-area concrete company can't dig up American Indian burial mounds located within its southern Wisconsin quarry, the state Supreme Court ruled Tuesday without any explanation. The court deadlocked 3-3 after Justice Daniel Kelly withdrew from participation, meaning the appellate ruling protecting the mounds stands. The three-sentence opinion doesn't offer any legal analysis or explanation, doesn't explain why Kelly withdrew and doesn't say which justices voted to uphold or overturn the lower court's ruling. The case revolves around Wingra Redi-Mix's eight-year effort to excavate effigy mounds within its quarry in Blooming Grove. The mounds are listed in the Wisconsin Historical Society's burial sites catalog, which means Wingra needs a state permit to disturb them.Wingra made the request for a permit in 2010 but the historical society denied it. The company asked the state Division of Hearings and Appeals to overrule the society. The Ho-Chunk Nation joined the dispute and argued … [Read more...] about Wisconsin high court backs Ho-Chunk in dispute with quarry, protects burial sites
