Nagaraj requires reconsideration by a larger bench. The five-judge bench headed by Chief Justice Dipak Misra heard a battery of lawyers, including Attorney General K. K. Venugopal, ASG Tushar Mehta, Senior Counsel Indira Jaising, P. S. Patwalia, Dinesh Dwivedi and Sanjay Hedge in favour of the reference and, inter alia, Senior Advocates Shanti Bhushan, Rajeev Dhavan, Rakesh Dwivedi and Shekhar Naphade in support of the 2006 ruling. At the hearing on Wednesday, senior advocate Rakesh Dwivedi, who represents those opposing quota in promotions, had told the bench that earlier there was presumption of backwardness with regard to scheduled caste and scheduled tribe communities. Within hours of the Parliament passing the Constitution(103rd) Amendment Act, which makes provisions for giving reservation to economically weaker sections in public employment and higher education, a petition has been filed in the Supreme Court challenging it. The petition is filed by "Youth For Equality", an NGO, contending that the amendment, violates the "basic structure" of the Constitution. Referring to the nine judges bench decision of the Supreme Court in Indira Sawhney case(1992), the petition states that reservation cannot be given on the basis of economic criteria. "That's why I got the little bag, and then I had to get back and get a grocery bag. It was sick."Mallett got the call to scoop it up Thursday evening."It took the two shovels and then the grocery bag, and because it got on the bag, I had to carry it with the other shovel, with the bag on the shovel, and take it directly to the dumpster to throw it in.""I think this is very disgusting," property manager Tonya Brecheem said.
