In the old West, there were a lot of cattle milling about. In order to tell one animal from another, each owner had a unique brand.More recently, Mad Men and their successors expanded the concept of brands to the consumer marketplace, to distinguish one product from another. We all recognize Volvo (safety), Nike (Just do it) and Frontier Airlines (A whole different animal).Today, the concept of branding has been further expanded to the professional services industry. With so many lawyers and law firms milling about, a brand is a valuable way to distinguish one lawyer and one law firm from another. What is a law firm brand? It is the firm’s reputation, its promise to the marketplace. This is who we are. This is what we do. This is who we do it for. This is what makes us different from every other lawyer or law firm that claims to do the same thing.By chance or on purpose, each law firm has a brand. If no one knows who you are … [Read more...] about New brand world: How law firms brand and re-brand

Corporate Affiliate Conflicts of Interest – GSI Commerce Solutions v. BabyCenter, L.L.C.
On August 18, 2010 the United States Court of Appeals for the Second Circuit addressed the issue of corporate affiliate conflicts of interest. This is an issue that frequently challenges lawyers considering whether they can represent a client who is adverse to a corporate affiliate of another client that they or their firms represent. In a unanimous opinion written by Senior Circuit Judge Ralph Winter, the Second Circuit has provided a useful analysis of the issue. The opinion affirmed GSI Commerce Solutions, Inc. v. Children Without a Country
Depending on whom you ask, Malik Jarno is either: A mentally challenged, orphaned teenager born in Guinea, with an IQ of about 60, who arrived in the United States bearing false identification papers and a plane ticket obtained by a friend in France who grew tired of caring for him; or he is a 20-something man, possibly born in the Congo, who tried to sneak into the States using papers he knew and understood were fake. The first version comes from a team of lawyers from three of the country’s largest and most formidable firms, who have been representing Jarno pro bono for the past several years. They say his parents were killed because they opposed the government in Guinea. Jarno fled with an aunt and two cousins to France, where the aunt left Jarno in the care of a family friend when she and her children moved to Belgium, the lawyers say. The friend cared for the rambunctious teen for several months, then bought Jarno a stolen passport … [Read more...] about Children Without a Country
