Judge Rules in Favor of DOJ Finding Bazaarvoice / PowerReviews Merger Anticompetitive (Department of Justice)

On January 8, 2014, Judge Orrick of the Northern District of California ruled that Bazaarvoice’s acquisition of competitor PowerReviews violated Section 7 of the Clayton Act.  The ruling was in favor of the U.S. Department of Justice (DOJ).  The public version of the opinion was made available on January 10.  In its self-described “necessarily lengthy opinion,” which spans 141 pages, the court ultimately found that the facts overwhelmingly showed the acquisition will have anticompetitive effects and that Bazaarvoice did not overcome the government’s prima facie case.  The case included 40 witnesses at trial, more than 100 depositions and 980 exhibits.  Dr. Carl Shapiro testified as DOJ’s economist and Dr. Ramsey Shehadeh testified on behalf of Bazaarvoice/PowerReviews.  The court noted that the case presented some difficult issues, including that there were no generally accepted “market share statistics … [Read more...] about Judge Rules in Favor of DOJ Finding Bazaarvoice / PowerReviews Merger Anticompetitive (Department of Justice)

A non-US-based commodity firm that allegedly tried to square up its books at month-end by placing matched buys and sells on a US futures exchange was charged with wash trading by the Commodity Futures Trading Commission. At the time – on or after first notice day in the relevant delivery month – the firm was precluded from transferring trades through book entry transfer transactions because of exchange rules. And last month an organization renowned for drafting model state laws approved a statutory framework for state regulation of persons engaged in a virtual currency business. ‘Acrobatics’ with a Twist–No Adobe

We tried Adobe Ac­robat in Lotus Notes mail, and it did the job very well. It al­lowed us to take one, some or all of our e-mails and preserve them in an Acrobat file. Attach­ments were also preserved in our limited testing. Similar Acrobat buttons add functionality to Microsoft Office applications.But with success comes imitators. Do an Internet search of “PDF utilities” and you will find a plethora of Acrobat wannabes. Third party applications that do some of what Acrobat does, or extend what Acrobat does, range in price from free to more than $170. The third party applications tend to focus narrowly, and some beat Acrobat regarding certain functions. Some are low cost enough to merit consideration by the cost conscious. When Microsoft surveyed Office 2003 users about features they wanted to see in Office 2007, most of the requests were for features already in Office 2003. That fits the time-honored maxim of computing: We use only 10 percent of the features of the programs we have.I have noticed that many lawyers who make innovative use of technology in their practices take advantage of program features not commonly used by others. Often, this results from the lack of budget or permission to install new programs.
