The past 18 months have been a busy time for the staffers investigating hospital mergers at the Federal Trade Commission (FTC). In December 2011, the U.S. Court of Appeals for the 11th Circuit affirmed a district court's denial of an FTC preliminary injunction motion,[1] from which the FTC and Solicitor General in March 2012 filed a petition seeking review by the U.S. Supreme Court (the "Phoebe Transaction"). Also in March, the FTC ruled that the 2010 acquisition of control over a rival health system in the Toledo, Ohio, area would have anticompetitive effects and ordered divestiture;[2] the parties reportedly plan to appeal (the "ProMedica Transaction"). Plan to merge fire authorities wins backing from county council
COUNTY civic chiefs have backed proposals for a cross-Solent fire authority. As part of its response to plans to bring together the already combined authority of Hampshire, Southampton, and Portsmouth with the new addition of the the Isle of Wight, Hampshire County Council says the new force would lead to ‘clearer accountability’.It adds the new force could lead to an ‘enhanced cutting-edge delivery of services’ which would benefit residents and businesses across the region.It comes as part of the consultation into the proposals, which ends on October 26.If the new authority is approved, fire bosses say it would allow the mainland services to better support the IoW and also allow them to modernise services on the island with £3m upgrades.The 11 stations will be brought in line with mainland standards. On December 1, 2014, the U.S. Centers for Medicare & Medicaid Services (CMS) released a 429-page Proposed Rule setting forth significant changes that will affect the evolution of the Medicare Shared Savings Program (MSSP) and opening discussions that could improve the financial sustainability of Medicare accountable care organizations (ACOs).The Proposed Rule shows CMS’s awareness of the challenges facing many MSSP ACOs and the likely need for further changes to improve MSSP ACOs’ return on investment through modifications to the financial methodology and additional tools to manage Medicare fee-for-service populations. Most notably, CMS has proposed to allow MSSP ACOs to continue with MSSP’s one-sided risk track for a second three-year term, but at a lower maximum shared savings rate, and to add a modified two-sided risk track that offers greater potential financial rewards and, for the first time, prospective beneficiary assignment.
