Justice Uday Umesh Lalit Appointed 49th Chief Justice of India, Will Succeed CJI Ramana
Supreme Court’s senior-most judge Justice UU Lalit was on Wednesday appointed as the 49th Chief Justice of India. He will succeed incumbent CJI NV Ramana, who demits office on August 26. “In exercise of the power conferred by the Constitution of India, the President of India is pleased to appoint Shri Justice Uday Umesh Lalit, Judge of the Supreme Court as the Chief Justice of India with effect from 27th August, 2022,” according to an official notification. Justice Lalit, a renowned senior advocate, has become the second CJI to be directly elevated to the Supreme Court Bench from the Bar. Prior to this, Justice SM Sikri, who was the 13th CJI of India appointed in January 1971, was the first lawyer to be elevated directly to the SC bench in March 1964. Lalit was designated as a senior advocate by the top court in April 2004. In January 1986, he shifted his practice to Delhi. Justice U U Lalit to Be New CJI: From Mumbai’s GLC to Landmark Kerala Temple, Triple Talaq Judgments
Appointed as the 49th Chief Justice of India, seniormost judge of the Supreme Court Justice Uday Umesh Lalit studied at the Government Law College in Mumbai and specialised in criminal law. He has been part of several landmark judgments, including the one which held the practice of divorce through instant ‘triple talaq’ among Muslims illegal and unconstitutional. He will succeed incumbent CJI NV Ramana . He will take the oath of office on August 27 and will retire on November 8. His tenure as the CJI will last only 74 days. He will be the second CJI who was directly elevated to the apex court Bench from the Bar. ‘Most Important Ingredient for Sexual Assault is Sexual Intent’: SC Quashes Bombay HC’s ‘Skin-to-Skin’ Order
The Supreme Court on Thursday quashed the Bombay High Court’s verdict which had held that no offence of sexual assault under the POCSO Act is made out if there is no direct skin-to-skin’ contact between accused and the victim. A Bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi held that the ingredient of the offence of ‘sexual assault’ under POCSO is sexual intent and skin to skin contact in such incidents is not relevant. The law has to be given an interpretation that gives effect to the intention of legislature instead of defeating it, the Court underscored. “The most important ingredient for constituting the offence of sexual assault is sexual intent and not skin to skin contact with the child. Construction of a rule should give effect to rule rather than destroying it. The intention of legislature cannot be given effect to unless wider interpretation is given,” the Court said.
