Nirav Modi Extradition Plea: UK High Court to Hear Evidence from Psychiatrists on Suicide Risk
The High Court in London will hear evidence from two psychiatrists on their differing views over the level of suicide risk posed by fugitive diamond merchant Nirav Modi if he were to be extradited to India, a two-judge panel ruled on Tuesday at a continuation appeal hearing. Lord Justice Jeremy Stuart-Smith and Justice Robert Jay concluded that three days, expected in October, will be set aside for a substantial hearing to address a change in the “evidential landscape” in the extradition case involving the 51-year-old diamond merchant. He is wanted in India to face charges of fraud and money laundering amounting to an estimated USD 2 billion in the Punjab National Bank (PNB) loan scam case and had lodged an appeal last year against a lower court’s extradition order on mental health grounds. “If even a significant proportion of this evidence is admissible, the evidential landscape has changed substantially since the District Judge’s decision (in favour of extradition),” said Lord … [Read more...] about Nirav Modi Extradition Plea: UK High Court to Hear Evidence from Psychiatrists on Suicide Risk
London View: After Initial Promptness in Proceedings, City Court Gives Nirav Modi New Lifeline
An appeals court in London has reversed its earlier push to speed up the extradition process for Nirav Modi . It now seems unlikely that there will be a final decision in the case this year. And the very possibility of extradition now seems less and less likely. Lord Justice Jeremy Stuart-Smith and Justice Robert Jay ruled on Tuesday that two psychiatrists who had given evidence in support of Nirav Modi should come back to give evidence before the court of appeal. The earliest possible date for that could be October. The judges have set three days for hearing that would include evidence from the psychiatrists and their cross-examination. Deja vu Further, the judges accepted a demand from Nirav Modi’s defence team for hearing fresh arguments from retired Supreme Court of India judge Markandey Katju who had given evidence to the magistrate’s court earlier in support of Nirav Modi’s case that he should not be extradited to India. Katju told the London court over a video link … [Read more...] about London View: After Initial Promptness in Proceedings, City Court Gives Nirav Modi New Lifeline
Floor Test, Governor’s Powers & Disqualification: Unpacking the Jargon as Maharashtra Simmers Over Revolt
Eknath Shinde’s rebellion, which has brought the Uddhav Thackeray government on its knees, has once again put the spotlight on the role of the Governor to call for a floor test amid fears that the Maha Vikas Aghadi government’s days are over. Under Article 174(2)(b) of the Constitution, the Governor has the powers to dissolve the Assembly on the aid and advice of the cabinet. However, the Governor can apply their mind when the advice comes from a chief minister whose majority could be in question. The Supreme Court, in the Shivraj Singh Chouhan & Ors versus Speaker, Madhya Pradesh Legislative Assembly & Ors, upheld the powers of the Speaker in 2020 to call for a floor test if there is prima facie proof that the government has lost its majority. In a 68-page judgment, a Bench of Justices DY Chandrachud and Hemant Gupta concluded that a Governor can call for a trust vote if he has arrived at a prima facie opinion, based on objective material, that the incumbent State … [Read more...] about Floor Test, Governor’s Powers & Disqualification: Unpacking the Jargon as Maharashtra Simmers Over Revolt
Explained | What are India’s laws on abortions?
The story so far: In a significant step backwards for women’s rights in the U.S., the Supreme Court overturned the landmark Roe v. Wade judgement of 1973, which gave women in America the right to have an abortion before the foetus is viable outside the womb or before the 24-28 week mark. With the setting aside of the historic judgement on abortion in the U.S, here’s a look at the laws that govern abortion in India. How did abortion laws come about in India? In the 1960s, in the wake of a high number of induced abortions taking place, the Union government ordered the constitution of the Shantilal Shah Committee to deliberate on the legalisation of abortion in the country. In order to reduce maternal mortality owing to unsafe abortions, the Medical Termination of Pregnancy (MTP) Act was brought into force in 1971. This law is an exception to the Indian Penal Code (IPC) provisions of 312 and 313 and sets out the rules of how and when a medical abortion can be carried out. … [Read more...] about Explained | What are India’s laws on abortions?
Opposition-ruled States Demand Continuation of GST Compensation at GST Council Meet
Chandigarh, Jun 28: States ruled by Opposition parties have demanded that either the revenue sharing formula under the GST regime should be changed or the compensation period should be extended by five years, amid concerns over revenue losses. The Goods and Services Tax (GST) was introduced on July 1, 2017, and states were assured of compensation for the revenue loss till June 2022, arising on account of the GST rollout. As the GST Council commenced here on Tuesday, the states have also cited a recent Supreme Court ruling that decisions made by the Council are not binding and states need not stick to them. The ruling by the court has been seen by some as states having powers to determine taxation. Chhattisgarh Finance Minister TS Singh Deo said the present formula for equally splitting revenues from the GST between the Centre and states should be changed, with a larger share of 70-80 per cent being given to states. Kerala Finance Minister KN Balagopal said the GST compensation … [Read more...] about Opposition-ruled States Demand Continuation of GST Compensation at GST Council Meet
US Should Stop Lecturing the World after American Women Get Demoted to Second Class Citizens
The United States of America is not as ‘united’ after all. A day after the US Supreme Court ruled that all American citizens have a “fundamental right” to carry firearms in public, it struck down the historic Roe v. Wade judgement of 1973 that conferred upon women in America the “constitutional right” to avail an abortion. Effectively, abortion is now due to become illegal in half of America’s states, either completely, or partially. Even a partial ban, however, would include a threshold of a maximum of six weeks during which a woman can avail an abortion. Usually, it is only after six weeks that a woman discovers she is pregnant. That essentially means women in America no longer have the agency to decide whether they need a baby or not. The states will now decide upon the parameters under which an abortion can be availed, if at all. Coming from a country that likes to refer to itself as the ‘beacon’ of modern democracy, this is quite a shameful precedent. Also Read: Roe v. Wade … [Read more...] about US Should Stop Lecturing the World after American Women Get Demoted to Second Class Citizens
12-hour Shifts, Age Bar on Health Checkups: Unions, Experts Slam ‘Pro-employer’ Draft Labour Code
Labour unions and experts have come out strongly against the draft rules under the Occupational Safety, Health and Working Conditions (OSH) Code, 2020. The new rules that aim to consolidate and amend all the laws regulating occupational safety, health and working conditions of dock workers, factory workers, construction workers and mines workers, among others, are being criticised for being heavily supportive of the employer and neglectful of the rights of employees. For instance, the current draft rules allow shift timings to be increased from eight hours to up to 12 hours, which some say when added to the time that it takes to travel to and from the workplace, will significantly increase the time employees end up spending on work. Health checkups have been made free for employees above 45 years of age. This provision has been criticised by some who believe that employers will constantly look for younger workers and do away with those approaching the specified age. The All … [Read more...] about 12-hour Shifts, Age Bar on Health Checkups: Unions, Experts Slam ‘Pro-employer’ Draft Labour Code
Rahul Gandhi’s Office in Wayanad Vandalised by SFI Activists; Kerala CM Assures Stern Action Against Culprits
A protest march of the SFI, the students wing of ruling CPI(M), against Congress MP Rahul Gandhi’s office here on Friday turned violent as a group of protestors allegedly entered the Lok Sabha member’s office and vandalised it, prompting Chief Minister Pinarayi Vijayan to strongly condemn the incident and warned stern action against the culprits. Alleging his inaction in the issue of buffer zones around forests, the Students’ Federation of India (SFI) workers on Friday held a protest march towards the Congress MP’s Office in Kalpetta in Wayanad district and allegedly vandalised it, drawing widespread condemnation from the party leaders and workers. While the Congress alleged that the Wayanad MP’s office was vandalised with the knowledge of the Chief Minister, Vijayan in a strongly worded message said this land ensures space for freedom of expression and democratic protest but it was a wrong practice if it turns into violence. Police said around eight people were taken into custody … [Read more...] about Rahul Gandhi’s Office in Wayanad Vandalised by SFI Activists; Kerala CM Assures Stern Action Against Culprits
