BREAKING: Justice AK Sikri Withdraws Consent To Appoint Him As President/Member Of CSAT
By: Live Law News Network 2019-01-13T20:07:09+05:30 Justice AK Sikri has withdrawn his consent to be appointed to the post of president/member of the Commonwealth Secretariat Arbitral Tribunal (CSAT), which was offered by Central Government. Reportedly, he was offered this post in London based CSAT, by Centre, last month and he was set to join this after his retirement, on 6th March 2019. This had given rise to a controversy, in the wake of decision of a high power committee, in which the judge was also a member, decided to transfer Alok Verma to the post of Director General Fire Services, for his residual term which will end on January 31. The committee consisted of Prime Minister Narendra Modi, Justice A K Sikri (CJI nominee) and Leader of Opposition Mallikarjun Kharge. By: ashok kini 2019-01-09 06:57:52.0 The Chief Justice of India Ranjan Gogoi has nominated senior most SC Judge Justice AK Sikri to be part of the high powered committee under to consider the allegations against CBI Director Alok Verma to avoid the conflict of interest in the Case. Apart from the Prime Minister, the Leader of Opposition, the committee also includes the Chief Justice of India or Judge of the Supreme Court nominated by him. Since the Judgment re-instating Alok Verma as CBI Director was authored by CJI Gogoi, he nominated another Judge to participate in the proceedings relating to Alok Verma. In the judgment authored by CJI, on behalf of the three judge bench, which quashed the Central Government and CVC orders against Alok Verma, the issue of divestment of power and authority of the Director, CBI was kept open for consideration by the Committee. In contrast, there is also a view that 68 years in the life of the Constitution is too a long journey. Why I say so? Thomas Jefferson in one of his letters to James Madison dated September 6, 1789, stated that constitutions should have a sunset clause providing for its expiration after 19 years and that, “if it is enforced any longer, it would be an act of force and not of right”[1]. 220 years later, a study conducted by scholars at the Chicago Law School under its Comparative Constitutions Project came out with a finding, after studying all the constitutions from 1789 to 2005, that the life expectancy of a national constitution was 19 years[2]. The book has been written by Yogesh Pratap Singh, Associate Professor of Law, NLU Odisha, who is currently on deputation as Deputy Registrar, Supreme Court of India. The book is published by Thomson Reuters at Indian Law Institute, New Delhi. The book traces the genealogy of dissent practice in common law tradition. It further establishes the link between judicial dissent, judicial independence and constitutionalism. Dissent functions as an intra-organ control within the institution.
