Federal Judges Expand Disability Law to Enforce Transgender Demands
A three-judge federal panel has declared people who say they are members of the opposite sex can use a 1990 disability law to enforce their demands on other people and groups. “We have little trouble concluding that a law excluding from ADA [Americans with Disabilities Act of 1990] protection both ‘gender identity disorders’ and gender dysphoria would [unconstituionally] discriminate against transgender people as a class,” said the opinion by Judge Diana Gribbon Motz, who was nominated by President Bill Clinton. The 2:1 decision by the Court of Appeals for the Fourth Circuit may be appealed to the U.S. Supreme Court. If the case survives, it will be used by advocacy groups to push the transgender ideology on state and local government, schools, companies, and civic groups. Three of America’s largest pharmacy chains, Walmart, CVS and Walgreens, were ordered to pay a nine-figure sum to two Ohio counties by a federal judge Wednesday for flooding those areas with opioids. After a federal jury ruled last year that the three retailers were a key part of the opioid crisis in Lake and Trumbull counties outside Cleveland, U.S. District Judge Dan A. Polster ruled this week that they did not take proper measures to stop abuse and resale of the pills in the afflicted communities after they sold them. A riff between two judges in the United States’ most conservative federal appeals court reflects the ongoing debate of accountability when a government potentially breaches the First Amendment. Trump-appointed Judge James Ho had some words for Chief Judge of the U.S. Court of Appeals for the Fifth Circuit Priscilla Richman, in an August 12 court opinion about a citizen journalist case. Laredo, Texas, citizen journalist Priscilla Villarreal was arrested for questioning police in 2017 after she was able to confirm the names of subjects in stories she wrote by contacting a Laredo Police Department officer. U.S. Magistrate Bruce Reinhart must decide what to do about the governments demand that the Mar-a-Lago search affidavit remain sealed. Former President Trump's lawyers have demanded the opposite: that the affidavit be unsealed and open to the public. Under the First Amendment, there is a strong presumption in favor of transparency and public availability of important documents. This presumption is rebuttable upon a showing of good cause. The showing cannot be a general claim that investigations should be protected; it must specifically point out names, words, and sentences whose unsealing would pose a significant danger. Unless such a showing can be made, secrecy is not justified in relation to important documents which the public has a legitimate interest in seeing. Accordingly, Judge Reinhardt should demand of the government that they make a showing of necessity sufficient to overcome the presumption of transparency. Alleged Capitol rioter wants out of house arrest to visit renaissance faire
A Pennsylvania woman accused of stealing House Speaker Nancy Pelosi 's laptop during the Capitol riot with the intent of selling it to Russia wants out of her house arrest so she can attend a renaissance fair, according to court documents. Riley Williams, of Mechanicsburg, made a request to a federal court to allow her to visit the Pennsylvania Renaissance Faire in Manheim this weekend, according to The Patriot-News, a Pennsylvania newspaper. The Pennsylvania Renaissance Faire is a longstanding event where hundreds of people dress up as figures from the 16th century and visitors can buy wares and food presented in the theme of the time period. Williams was charged with trespassing as well as violent entry and disorderly conduct on Capitol grounds on Jan. 6, 2021, both of which are misdemeanors. Other charges presented against Williams include theft of government property and obstruction of an official proceeding, which carry possible sentences of 20 years in jail. Criminal case filed against China alleging genocide of minorities
A criminal complaint has been filed accusing Chinese officials of the genocide of Uyghurs and other minority groups. Lawyers for the World Uyghur Congress (WUC) and the Uyghur Human Rights Project (UHRP) submitted the complaint in Buenos Aires, Argentina, on August 17. They allege that the Chinese government has committed crimes against humanity targeting Uyghurs and other Turkic peoples in the Xinjiang province. Beijing's "re-education" policies in the northwestern province have been the subject of international scrutiny for several years. The Uyghur Forced Labor Prevention Act was signed by President Joe Biden last December. In April a State Department report said more than 1 million Uyghurs and members of mainly Muslim groups had been arbitrarily imprisoned and subjected to forced sterilization, coerced abortions and rape. China has denied the allegations . Japan launches campaign for young people to drink more to boost economy
Japan's national tax agency has reportedly launched a national competition in hopes to make alcoholic drinks more attractive to the younger generation, boosting the economy in turn. The "Sake Viva" campaign asks 20-39 year-olds to share their business ideas to increase demand for alcoholic drinks including Japanese sake, shochu, whiskey, beer or wine. This contest was devised after a realization that Generation Z (people born between 1997 and the early 2010s) is drinking less alcohol which has hit taxes for adult beverages. Recent trends have indicated that Generation Z drinks less than millennials, a trend that has resulted in lower alcohol sales and therefore less income for the government through taxes. Sox has licensed 100 episodes of the standup comedy showcase series that ran on A&E Network in the early 1990s. Those will be collected with new installments that Hirsch and Sox Entertainment will produce.
