And is an application for anticipatory bail at the instance of a child in conflict with law maintainable before the high court or the Court of Session? Justice R Narayana Pisharadi of Kerala High Court has decided the questions as he held that a child in conflict with law can very well apply for anticipatory bail as there is nothing in the Juvenile Justice (JJ) Act which bars him/her from doing so. He also held that an application for anticipatory bail under Section 438 of the Criminal Procedure Code at the instance of a child in conflict with law is maintainable before the high court or the Court of Session. Registration of Child Care Institutions mandatory under JJ Act, 2015

A total of 1137 Children Homes and 283 Specialized Adoption Agencies are currently functioning in the country under Integrated Child Protection Scheme. The WCD Ministry has been requesting the State Governments/UT Administrations from time to time to identify and register all Child Care Institutions (CCIs) under the provisions of Juvenile Justice (Care and Protection of Children) Act (JJ Act), so as to ensure that minimum standards of care can be maintained. Under Section 41 of the JJ Act, 2015 registration of CCIs has been made mandatory with penalty in case of non-compliance. Under Section 54 of the JJ Act,2015 the State Governments are required to appoint inspection Committees for the State and district for mandatory inspection of all facilities housing children, at least once in three months.Further, under ICPS the financial norms were revised with effect from 1st April, 2014. Juvenile law “far too liberal”; take a relook at the JJ Act: SC to Government

A Supreme Court bench comprising of Justice Dipak Misra and Justice U.U. Lalit has described the punishment for “admonition” and “group counseling” for juveniles as punishment for even severe crimes, as “far too liberal” and urged Attorney General Mukul Rohatgi to suggest a relook at the Juvenile Justice (Care and Protection of Children) Act, 2000  by the Government.Mr. Rohatgi said “maximum” number of grave offences are committed by juveniles between 16 and 18 years of age. “That is why,” he said, “we want to reduce the age to 16”.Justice Misra asked, “In a population of 1,000, one per cent may be juveniles who commit rape and murder. But even this one per cent can be a menace. Kidnapping Of Child A Bailable Offence Under IPC Becomes Non-Bailable Under JJ Act: A Discussion By Rakesh Kumar Singh

In the present paper, we will discuss the effect of newly enacted Juvenile Justice (Care and Protection of Children) Act, 2015 vis a vis offences related to kidnapping and abduction as envisaged in IPC, 1860. We know that kidnapping of a child below certain age (different for male & female) from lawful guardian is an offence punishable upto 7 years imprisonment but is a bailable offence. Prime issue herein is whether the enactment of new JJ Act which covers every persons under 18 years of age irrespective of gender affects the nature of offence of kidnapping. A purposive reading of JJ Act will go to show that it really affects the kidnapping provisions of IPC on crucial aspects. There are some provisions of JJ Act such as Section-84, 85, 86 which need consideration.
