Responding to a Hyper-Competitive Legal Market: 2015 and Beyond

· October 21, 2015 ·

The results of Citigroup’s 2015 Law Firm Leader’s Peer Monitor Report were examined by a highly informative panel[i] at Thomson Reuters’ recent 20th Annual Law Firm Leaders Conference in New York. The detailed discussion outlined overall marketplace trends and reviewed the strategies of law firms who are profitably navigating today’s turbulent legal market.Market conditions for law firms are stabilizing in 2015 but a fragile global economy / geopolitical climate, and changing legal department purchasing behavior are leading to continuing flat demand for purchasing legal services. Current marketplace conditions include: more work being done in-house or by non-law firm outsourced providers and law firms coming in from other markets who are competing aggressively on price and / or who are buying business growth by lateral attorney hires.Lower demand for law firms’ services is also being driven by a decreased appetite for costly litigation and developing … [Read more...] about Responding to a Hyper-Competitive Legal Market: 2015 and Beyond

NC Court of Appeals Weighs in on Multiple Creditor’s Rights Issues

· August 1, 2015 ·

The NC Court of Appeals has issued a number of opinions this year involving lender foreclosure or collection efforts. Not all of the holdings have been monumental, but there is a common thread of useful principles, summarized here:I. Defaulting Foreclosure Bidder Gets Full RefundGlass v. Zaftrin, LLC: At issue in this foreclosure was a defaulting bidder’s claim for refund of its bid deposit where there was a subsequent resale of the property at a price greater than the original bid. The facts were simple.  Zaftrin was the high bidder at a foreclosure sale and paid its bid deposit to the Clerk. Zaftrin thereafter notified the trustee it was unable to complete the purchase, and the property was resold at a higher price. The trustee moved for an order to disburse the bid deposit back to Zaftrin, but sought to deduct the costs of resale. The trial court granted the trustee’s motion over Zaftrin’s objection. On appeal, the Court of Appeals reversed and awarded … [Read more...] about NC Court of Appeals Weighs in on Multiple Creditor’s Rights Issues

Lexington-Bluegrass Association of Realtors (LBAR) Launches App, Just As Industry Giants Merge & New Concerns Arise

· August 14, 2014 ·

Zillow and Trulia, the two largest sites in the home listings game, are merging. These sites enable buyers to navigate an online map to find a home’s value, look at available listings, and connect with local real estate agents. And while the companies, nearly a decade old, have somewhat helped to streamline the home buying and selling process, real estate deals remain a transaction that largely require professional assistance – from agents, to bankers, to attorneys. Even with online assistance from sites like Zillow and Trulia, most homebuyers prefer one-on-one guidance and advice from a trusted professional. The merger, which will result in the two companies becoming by far the biggest online portal in the industry, has caused concern throughout the residential brokerage business. Some are worried that the merger will result in the company having too much power over listings, possibly raising associated fees. There has even been talk that the company might now break into … [Read more...] about Lexington-Bluegrass Association of Realtors (LBAR) Launches App, Just As Industry Giants Merge & New Concerns Arise
