Beware Scrollable Window: Seventh Circuit Strikes Down Internet Contract

· March 30, 2016 ·

If you’re like us—and most others, we’ll venture to guess—you’ve never read all the terms and conditions of the iTunes end-user license agreement. We doubt that it’s a scintillating read, but, regardless, most consumers don’t slog through these contractual tomes because they have better things to do.Apple and others in the world of e-commerce know this, but they need to rely on some form of contract for their services, so the struggle begins to create a binding contract (where a purchaser “receives reasonable notice of those terms”) when the purchaser doesn’t devote the time or attention to reading the essential terms. The Seventh Circuit’s recent decision in Sgouros v. TransUnion Corp., No. 15-1371 (7th Cir. March 25, 2016), decided under Illinois law, is a cautionary tale for those that operate in this digital realm. The court declined to enforce an arbitration provision because that term was buried at the bottom of a … [Read more...] about Beware Scrollable Window: Seventh Circuit Strikes Down Internet Contract

Valedictorian Outed Herself as Undocumented, and the Internet Exploded

· June 10, 2016 ·

Podcast: Play in new window | DownloadSubscribe: Android | RSSThe valedictorian at a Texas high school had a 4.5 GPA, earning herself a full college scholarship. While working hard for four years to achieve that, she kept a secret.  Mayte Lara Ibarra of Austin revealed herself on Twitter after speaking at graduation, saying that she is an undocumented alien, the Washington Post reported. Quick Cuts: Save Time with a Few Strokes at the Keyboard

· August 1, 2011 ·

Sometimes the smallest improvements result in big productivity gains. And in computing there might not be anything smaller and simpler than keyboard shortcuts. Keyboard shortcuts eliminate steps and reduce the time necessary to complete often-repeated actions. It’s not so much that a few seconds here and there add up (they do), but that common tasks become easier and feel like actions as opposed to processes. One reason for using keyboard shortcuts is that you can initiate actions as you type without reaching for your mouse. The beauty of shortcuts is that you only need to learn a few that apply to your needs to see a benefit. You may have seen long lists of complex and gymnastic keystroke shortcuts (like Control-Shift-F7) that overwhelm with the sheer volume of commands. But here are some of the best and most helpful shortcuts. Try as few or as many as you want to see where you get the most benefit.Because more lawyers are using Macs, I will give you the Mac equivalents for … [Read more...] about Quick Cuts: Save Time with a Few Strokes at the Keyboard

Seven rent-to-own companies and a software design firm have agreed to a settlement with the Federal Trade Commission concerning computers that the retailers rented to customers and then used to spy on them without disclosing in advance that the companies intended to do so.They will not be fined, but have agreed to restrict the use of PC Rental Agent software developed by Pennsylvania-based DesignWare that previously allowed more than 1,600 licensed rent-to-own stores in the United States, Canada and Australia to spy on over 400,000 customers, according to an FTC press release, the Hill’s Hillicon Valley blog and the The Risk Assessment/Security & Hactivism page of Ars Technica. An FTC complaint earlier this year said the software could be used by retailers to track the geophysical location of rent-to-own computer users, to monitor their online activities and obtain passwords to social media and bank account sites and to photograph individuals near the computer. Several were … [Read more...] about 7 Retailers Settle with FTC, Agree to Stop Spying on Up to 400,000 Computer Rental Customers
