Fantasizing about violence isn’t a crime, a federal appeals court says in an opinion on Thursday that tosses the convictions of a former New York police officer dubbed the “cannibal cop.”The 2-1 decision (PDF) by the New York-based 2nd U.S. Circuit Court of Appeals affirms a federal court decision that overturned Gilberto Valle’s conviction for conspiracy to commit kidnapping. The appeals court also overturned Valle’s conviction for accessing a law enforcement database to collect information on a potential victim. The Associated Press, the Volokh Conspiracy and Reuters covered the decision.Valle had accessed Internet chat rooms where he talked about plans to rape, kill and cannibalize women. The appeals court said it is difficult to identify the line between fantasy and criminal intent, but in this case evidence did not show his ‘gruesome’ online fantasy life had crossed that line.Dates for planned kidnappings came and went, and impossible … [Read more...] about Appeals court tosses conviction in ‘cannibal cop’ case, says fantasizing about murder isn’t a crime

The rulings came quickly this past summer in a steady drumbeat that pleased progressives and disappointed conservatives.A strict voter identification law in Texas—blocked. A North Carolina law that required voter ID, which reduced early voting and changed registration procedures—struck down for not only having discriminatory effects but also for having been passed with a racially discriminatory motive. North Dakota’s voter ID law—blocked because of bias toward Native Americans.Under an election law in Wisconsin, one federal district judge ordered an affidavit procedure for those without ID; days later, another district judge struck down provisions that limit early voting and increase residency requirements. The string of recent rulings deals serious blows to measures advanced by many Republicans in the name of election integrity, while others view them as discriminatory. The rulings indicate that “there is a limit in how far states can go in rolling back … [Read more...] about Appeals courts are dismantling stricter voter ID laws
Judge accused of sexual harassment wins appeals court seat
An Ohio common pleas judge won an appellate court seat on Tuesday, the same day that a Columbus newspaper obtained details of sexual harassment allegations against him.The Franklin County Judge, Tim Horton, was unopposed in his bid for a seat on the county court of appeals, the Columbus Dispatch reports. He denies the allegations. The complaint was filed by Elise Wyant, Horton’s former secretary who later became his bailiff.Wyant had claimed she was forced to resign because court executive director Atiba Jones didn’t act on her complaints of sexual harassment by Horton, the Columbus Dispatch says. She alleged that she and the judge often went out drinking together, and on one occasion she vomited in his car.The Columbus Dispatch obtained Wyant’s … [Read more...] about Judge accused of sexual harassment wins appeals court seat

Justice Kennedy, 81, has been a critical swing vote on the sharply polarised court for nearly three decades as he embraced liberal views on gay rights, abortion, and the death penalty but helped conservatives trim voting rights, block gun control measures and unleash campaign spending by corporations. Interestingly though, with Justice Kennedy mostly siding with conservatives this year, the court endorsed Mr. Trump’s power over immigration, dealt a blow to labor unions and backed a Republican purge of voter rolls in Ohio. Nevertheless, his replacement by a conservation … [Read more...] about Indian American Amul Thapar On Trump’s List Of Supreme Court Nominees
