New Documentary Requirements Issued for Hong Kong Exports and Reexports

The US Department of Commerce’s Bureau of Industry and Security (BIS) recently issued a Final Rule imposing new support document requirements with respect to exports to Hong Kong.Exports to Hong KongUnder the terms of the Final Rule, US exporters intending to export to Hong Kong any item subject to the Export Administration Regulations (EAR) that is controlled on the Commerce Control List (CCL) for national security (NS), missile technology (MT), nuclear nonproliferation (NP column 1), or chemical and biological weapons (CB) reasons must obtain—prior to shipment—a copy of a Hong Kong import license or, alternatively, a written statement issued by the Hong Kong government that an import license is not required. Two major marches were carried out to mark the Labor Day, organized separately by the Federation of Trade Unions and the Confederation of Trade Unions (CTU).The organizers urged the government to put in place the two policies immediately, stating that the Chief Executive of Hong Kong, Leung Chun-ying, whose current term in office ends July next year, promised to get the polices implemented. Protesters also demanded abolition of the so-called offset provision in the Mandatory Provident Fund — Hong Kong’s existing retirement savings scheme — which according to critics does not benefit employees. Macau also faced blackout due to power supply cable failure in the neighboring city of Zhuhai.
