National Herald Case: AJL Files Appeal In Delhi HC Against Single Judge Order
By: PTI 2019-01-07 06:11:35.0 Associated Journals Ltd (AJL), the publisher of National Herald newspaper, has approached the Delhi High Court challenging a single judge order asking it to vacate the premises in press enclave at ITO here. It has also sought a stay on the operation of single judge's December 21, 2018 order. Advocate Sunil Fernandes, representing the AJL, said the appeal was filed on Saturday evening and it is likely to come up for hearing on January 9. The high court had dismissed the AJL's plea challenging the Centre's order to vacate its premises by holding that the publisher of the National Herald has not provided any instances to support the serious allegations of malafide levelled against the ruling dispensation. It had said AJL will have to vacate the ITO premises within two weeks after which eviction proceedings under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971, would be initiated. Simplified International Filing of Design Patents Coming in May
The United States has finally taken the steps necessary to join a major international treaty concerning the protection of design patents. This will mean significant changes in the protection of designs in foreign countries. At present, U.S. design patent applicants have six months after the U.S. filing date to file foreign design applications claiming priority to the U.S. filing, and the foreign applications must be filed separately in each country. In countries that adopted the 1999 Geneva Act of the Hague Convention Concerning the International Registration of Industrial Designs, filers enjoy a simplified procedure for filing design applications in all member countries.Although the United States adopted this Hague Convention in December 2012, the final steps necessary to achieve membership only recently took place on February 13, 2015, and the Hague Convention will be effective for U.S. design applicants starting on May 13, 2015. Justice M.S. Ramesh observed, “There are also cases where women are constrained to raise children with their own sources in view of their unwilling and unconcerned partners. It would be totally unjustifiable to insist such single or unwed mothers to compel them to declare the name of the father of the child who has chosen to abandon the child.” The Court was hearing a petition filed by one Ms. Mathumitha Ramesh, who had given birth to a child in April last year through intrauterine fertility treatment.
