Revisiting Proposed Regulations After Legal ChallengesThe NLRB has recently suffered a number of legal setbacks to its proposed regulations. However, now that the Board is fully staffed, it is likely that the NLRB will attempt to revisit many of these proposed regulations. For example, one proposed regulation that the Board will likely revisit is the so-called Quickie Election Rule, a rule that drew significant criticism when it was first introduced. The Quickie Election Rule was initially issued by the Board in 2011 and would have resulted in a dramatic shortening of the time between the filing of a union election petition and the election itself by limiting the ability of employers to be heard on preelection and post-election disputes. Employer Posting Requirements Under New Jersey Law
Employers are mandated under New Jersey law to display a variety of official posters informing employees of the law relating to their rights and responsibilities. An employer that fails to comply with these requirements may face monetary fines and other penalties. Generally, to ensure compliance, an employer must post the most recent version of the posters in locations accessible and easily visible to all employees and applicants for employment, such as a lunchroom, break-room, or human resources office. New Jersey also requires that certain of the notices be distributed to employees. 2016 New York Employment Law Year In Review
Finally, just after the New Year, on January 4, 2017, the New York State Senate introduced a bill which would make it an unlawful discriminatory practice for an employer or licensing agency, because of an individual’s status as a victim of domestic violence, to refuse to hire, employ or license the individual, to bar or discharge the individual from employment or to discriminate against the individual in compensation or terms, conditions or privileges of employment. Additionally, the bill provides that it shall be an unlawful discriminatory practice for an employer to refuse to provide reasonable accommodations to an employee who is known to be a victim of domestic violence. OFCCP Reminds Contractors to Display EEO Posters
On July 14, 2017, the Office of Federal Contract Compliance Programs (OFCCP) reminded all contractors and employers covered by the agency’s nondiscrimination and EEO laws of their posting obligations. According to the OFCCP’s email and website, contractors must prominently post the “Equal Employment Opportunity is the Law” poster on their premises.
