A FUGITIVE who is the double of EastEnders actor Dean Gaffney is wanted by police after failing to turn up for his trial. Tony Owens, 37, is accused of causing the death of a pensioner in a crash on the M42 motorway. The Lethal Trojan in Indian Penal Code; Sec 307-Part-II
Justice Kurian Joseph opened the judgment in Sunil Damodar Gaikwad [2014] by witting – “Death and if not life, death or life, life and if not death, is the swinging progression of the criminal jurisprudence in India as far as capital punishment is concerned.” Our statute books though resistantly, provide death for social, political and economic crimes. Interestingly, two diametrically opposite views have been witnessed recently in this context. The 262nd Law Commission of India Report recommended abolition of death penalty save in certain cases, while on the contrary a 3 judge bench of the Supreme Court in Vikram Singh [CA No. 824/2013] approved constitutional validity of capital punishment under Sec. 364A of the Indian Penal Code (IPC).There are 511 sections in IPC, 54 of which project Life Imprisonment as a sentence, 11 overlapping amongst these prescribe death as the maximum punishment and only 6 in this bracket are non-homicidal in nature. It is here where the … [Read more...] about The Lethal Trojan in Indian Penal Code; Sec 307-Part-II

California has been burned by a “scorched-earth” approach to litigation over pay policies for inmates who work for private employers on prison grounds.A California appeals court affirmed an award of $307,000 in attorney fees, in addition to nearly $1.5 million already awarded, for litigation over the state’s failure to comply with a stipulated injunction regarding a prison ballot measure, the Recorder reports.“The state ignores that its own conduct has extended the litigation and substantially increased awardable fees,” the court wrote in its opinion (PDF). “As the [trial] court explained, ‘the state has in the history of this case, taken a scorched-earth, drag-your-feet … approach to the litigation where it has fought tooth and nail to avoid doing what it voluntarily agreed to do.’ “The plaintiff had sued for the state’s failure to carry out Proposition 139, which required California to compel employers who hired … [Read more...] about $307 K Fee Is Price of Foot-Dragging
