Bombay High Court Today allowed the Appeal filed by Bollywood superstar Salman Khan against a Trial Court verdict which sentenced him for Five Year Imprisonment in the 2002 Hit and Run Case. Justice A.R.Joshi acquitted him of all charges holding that the prosecution failed to prove the Case beyond reasonable doubt.On 28 September 2002, Salman Khan’s car had run over a group of persons who were sleeping in front of a suburban bakery on the pavement. The accident had resulted in death of a person and had injured four others. He has been found guilty of various Sections under the Indian Penal Code, including S. 304 Part II, Motor Vehicle Act and Bombay Prohibition Act. SC notice to Salman in Maharashtra Govt Appeal against his acquittal in 2002 Hit and Run Case
The Supreme Court today issued notice to bollywood superstar Salman Khan on the appeal filed by Maharashtra Government against his acquittal of Bollywood in the 2002 hit and run case.A bench headed by Justice J S Khehar asked senior lawyer Kapil Sibal who appeared for the star to file a response within six weeks.As Sibal stiffly opposed the notice saying all the “so-called evidence” were flimsy and not a single witness corroborated the police version and no one identified salman as the person behind the wheel, Attorney General Mukul Rohatgi said several of those injured had given sufficient evidence to convict him.At this stage Justice Khehar told Sibal: ” it is open to you to take notice. If this court acquits you you will be vindicated for all time. I feel it would be much much much better if you accept notice and file a reply” to which Sibal agreed. U.S. Federal Court issues summons against Modi for his alleged role in “2002 Gujarat Genocide”
A Federal Court in U.S. has issued summons against Prime Minister Narendra Modi, in a lawsuit filed by the American Justice Centre (AJC), for his alleged involvement in the anti-Muslim pogrom in Gujarat during 2002, which has been termed as the “2002 Gujarat Genocide” by the plaintiffs. Modi was the Chief Minister of the state at the relevant time.Specifically the twenty-eight page complaint filed was said to seek compensatory and punitive damages and “charges PM Modi with committing crimes against humanity, extra-judicial killings, torture and inflicting mental and physical trauma on the victims, mostly from the Muslim community”.The non-profit human rights organization has reportedly called for a response from the PM on the Alien Tort Claims Act (ATCA) and the Torture Victim Protection Act (TVPA). Bombay HC gives two day interim bail to Salman Khan as actor gets 5 years in jail for 2002 hit and run case [Updated]
12 years after the unfortunate accident in Mumbai that resulted in death of a person, Salman Khan has been held guilty of all charges in the 2002 hit and run case and has been awarded a jail term of 5 years. However, the Bombay High Court, that heard his bail plea at 4 pm today, granted an interim bail of two days as the actor is yet to get the complete copy of the judgment by which he was convicted and sentenced to five years in prison.Reportedly, the lower court judge told Salman Khan, “this has been proved that you were driving the car.” With Salman Khan being convicted, the Court will decide on the quantum of punishment today.Reportedly, the Court relied on judgments pronounced in Alistair Pereira case and Nikhil Nanda BMW case of Delhi while convicting Salman.After pronouncing the sentence, the Court reportedly asked Salman if he had to say anything, to which he denied the charge and said that he was not driving the car. After a year-long hearing, the Supreme Court reserved its verdict on the issue.The Gujarat government has raised this pertinent question. The issue came into focus after the destruction of such structures during the 2002 Gujarat riots.The bench of Justices Dipak Misra and Prafullah C Pant was hearing a petition filed by the Gujarat Government challenging the 2012 order of the High Court directing it to pay compensation to over 500 shrines damaged during the post-Godhra riots.
