Brazil’s top court rules against da Silva’s bid to avoid prison

After nearly 11 hours of often heated debate, the justices of the Supreme Federal Tribunal voted 6-5 to deny da Silva’s preventative habeas corpus request to stave off a 12-year jail sentence while he fights a conviction in a case that he argues was nothing more than a ploy to keep him off of October’s presidential ballot. Despite the conviction and several other corruption charges pending against him, da Silva leads all preference polls for the election. The decision means he will likely be jailed soon, though probably not until at least next week thanks to various technicalities. As jail looms for Brazil’s da Silva, his party vows to fight

SAO PAULO (AP) — The head of Brazil's Workers' Party on Thursday warned that jailing former President Luiz Inacio Lula da Silva would turn Latin America's largest nation into a "banana republic," while the former leader's lawyers said they were filing injunctions in hopes of keeping him out of prison. The comments came just hours after the Supreme Federal Tribunal, by a 6-5 vote, denied a petition by da Silva to stave off a 12-year sentence while he appeals a corruption conviction that he and supporters say is a ploy to keep him off October's presidential ballot. Despite the conviction and several other charges against him, da Silva leads preference polls ahead of the election. Without an unforeseen successful legal maneuver, which up until now has eluded da Silva, he will likely be jailed within the next several weeks. This is the second case in which he was arrested by the Lalbagh police in Cuttack on 8 August last year for allegedly posting defamatory remarks against Lord Jagannath and Gajapati King Dibyasingha Deb on Facebook. Last month, the Orissa High Court had granted him bail in a cyberstalking case in which Das was convicted and sentenced to six-year jail. Das is presently lodged in a jail in Puri. His appeal against the conviction order is pending in a sessions court. Patterson lived just down the street, and on that day - Jan. 11, 2007 - he told police that he ran outside into his front yard after he heard three or four shots ring out. His neighbor pointed to the body lying on the ground outside the store and asked Patterson if that was his friend. Running closer, Patterson could see that it was, he told police. He started yelling, "Oh, my God! Is he dead? Is he dead?" as a witness soon described to police, according to court documents. Within hours, Patterson would be in the back of a police car.
