Affordable Care Act Patient Protections Provisions for Out-of-Network Emergency Department Services

The Affordable Care Act reorganized, amended, and expanded Part A of Title XXVII of the Public Health Service (PHS) Act, adding, among other items, the patient protections provisions that appear in PHS Act Section 2719A. The Affordable Care Act then inserted PHS Act Sections 2701 through 2728 into Employee Retirement Income Security Act of 1974 (ERISA) and the Internal Revenue Code, by adding Section 715(a)(1) to ERISA and Section 9815(a)(1) to the Internal Revenue Code. The result: these provisions apply to group health plans and to health insurance issuers that provide health insurance coverage in connection with group health plans.PHS Act 2719A includes requirements relating to benefits for emergency services. Interim final regulations were issued on June 28, 2010; the November 18, 2015 final regulations adopt the 2010 interim final regulations without substantial change.So far, so good. Wisconsin Informed Consent Bill Signed Re: Physician Obligations

Governor Walker signed a bill on Friday December 13th changing physicians’ informed consent obligations in Wisconsin. Section 448.30 of the Wisconsin statutes requires doctors to obtain patients’ informed consent for treatment. Assembly Bill 139 (the bill signed Friday) modifies section 448.30 of the Wisconsin statutes in the following significant ways:In litigation, juries will use the “reasonable physician” standard rather than the “reasonable patient standard” in determining whether a physician has met his or her informed consent duty; expert testimony will typically be necessary;Physicians do not have a duty to obtain informed consent for conditions they have ruled out.The change in the statute followed a 2012 Wisconsin Supreme Court decision in Jandre vs. Injured Patients and Families Compensation Fund. Former Chinese Political Superstar Pleads Guilty to $27 Million Bribery Charge

Sun Zhengcai, formerly one of China’s rising political stars and a possible successor to President Xi Jinping, completed his fall from grace on Thursday by pleading guilty to taking $27 million in bribes between 2002 and 2017. At 54 years of age, Sun was a relatively fresh face among China’s political elite, formerly the youngest member of the Politburo and party boss of the populous city of Chongqing. Passenger Fined $11,000 For Opening Emergency Exit On ‘Stuffy’ Plane For Fresh Air

World Plane Flight A passenger waiting to exit a plane after it landed said he was fined $11,000 after opening the emergency door because the packed plane was “stuffy.” A 25-year-old man, identified only as Chen by the South China Morning Post, said he flew from the island of Hainan to Sichuan, China, before the deplaning incident at the Mianying airport. After deciding he needed some fresh air, he pulled a handle he said he didn’t realize was attached to his row’s emergency exit door. Upon realizing the emergency slide was deploying automatically at the same time the door came inward, he said he “panicked.” “Because it was so stuffy, so hot on the plane, I just pushed down on the window handle beside me. When the door fell out, I panicked,” the man told ThePaper.cn, later translated by South China Morning Post.
