In the Indian context, the momentous judgement of the Supreme Court in Justice K. S. Puttaswamy (Retd.) and Anr. vs Union Of India And Ors is a remarkably concrete touchstone upon which developments that deals with privacy may be examined. The judgement affirms that privacy in India is a right that protects interests ‘pertaining to the physical realm and interests pertaining to the mind’. The petition filed by Nalini Chidambaram, Senior Advocate and wife of ex-Finance Minister P Chidambaram, challenged the Madras High Court decision refusing to quash the summons issued by ED. The summons issued under Section 50 of Prevention of Money Laundering Act (PMLA) required Nalini Chidambaram to appear before the authorized officer of the ED in connection with the Saradha Chit Fund Scam. The couple moved the apex court once Bombay High Court rejected their anticipatory bail application and Justice SS Jadhav made sharp observations against their professional conduct and held that this was a case of prescription without diagnosis. A bench of Justice AM Sapre and Justice UU Lalit granted the couple protection from arrest and directed them to co-operate in the investigation process.
