It is a known fact that counsels may appear for various reasons not limited to payment of fee,” Justice Sanjeev Sachdeva observed. The Court was hearing a Petition filed by one Ms. Sonia Gupta, challenging an order passed in May, 2017 whereby her application for interim maintenance had been rejected by the Trial Court. One of the orders challenged before the Bench comprising Justice S. Ravindra Bhat and Justice A.K. Chawla had allowed a plea by the Income Tax Department for early hearing on an appeal filed by the duo, without giving them a notice. While the Department had submitted that an order directing early hearing is merely administrative, the Court opined that the view was “incorrect”, relying on the ITAT’s decision in the case of Olympia Paper & Stationery Stores vs. Assistant Commissioner of Income Tax, 63 ITD 148. The Bench comprising Justice S. Ravindra Bhat and Justice A.K. In doing so, ACJ Mittal interacted with students of Modern School, Barakhamba Road, on Tuesday morning before the court hours and explained them the purpose of the sensitization program whose idea was conceived by ACJ Mittal herself.
