Share Tweet Plus One Pin It Email Print By: Apoorva Mandhani May 5, 2018 7:51 pm Change Font Size The Delhi High Court on Wednesday refused to accept denial of maintenance to a woman merely on the ground that she had engaged reputed Counsel for her application and had thereby spent huge amount of money in the process. “…the mere fact that a party engages counsel of repute does not ipso facto imply that the said party has sufficient funds. It is a known fact that counsels may appear for various reasons not limited to payment of fee,” Justice Sanjeev Sachdeva observed. The Court was hearing a Petition filed by one Ms. Sonia Gupta, challenging an order passed in May, 2017 whereby her application for interim maintenance had been rejected by the Trial Court. The sole reason for the rejection of the application was that the Petitioner had claimed to have spent Rs. 3,00,000 per month in engaging reputed lawyers. With this information, the Trial Court had … [Read more...] about Mere Engaging Of Reputed Counsel Does Not Imply Sufficiency Of Funds: Delhi HC [Read Judgment]

Share Tweet Plus One Pin It Email Print By: Apoorva Mandhani May 5, 2018 3:06 pm Change Font Size The Delhi High Court on Friday set aside two orders of the Income Tax Appellate Tribunal (ITAT) on appeals filed by NDTV co-founders Prannoy Roy and Radhika Roy. One of the orders challenged before the Bench comprising Justice S. Ravindra Bhat and Justice A.K. Chawla had allowed a plea by the Income Tax Department for early hearing on an appeal filed by the duo, without giving them a notice. While the Department had submitted that an order directing early hearing is merely administrative, the Court opined that the view was “incorrect”, relying on the ITAT’s decision in the case of Olympia Paper & Stationery Stores vs. Assistant Commissioner of Income Tax, 63 ITD 148. In the said case, the ITAT had categorically recognized an order for early hearing as a judicial order. The second impugned order allowed the IT Department to place additional evidence … [Read more...] about Delhi HC Sets Aside ITAT Orders In NDTV’s Prannoy Roy’s Tax Case [Read Order]

The Bench comprising Justice S. Ravindra Bhat and Justice A.K. Chawla however directed such students to report an hour earlier for the entrance test for proper screening, noting, “If upon screening it is discovered that any candidate is actually carrying, within the kara or kirpan, a suspect device, he may be asked not to take it in the examination hall.” The Court was hearing several Petitions, including one filed by the Delhi Sikh Gurdwara Management Committee, challenging the restrictions imposed on candidates precluding them from wearing the kara and the kirpan, which are … [Read more...] about NEET-2018: Delhi HC Allows Sikh MBBS Aspirants To Wear Kara And Kirpan; Directs Them To Appear An Hour Before For Screening [Read Order]
