Judiciary has never tried to make death penalty redundant: SC judgment

In a blow to death penalty abolitionists, the Supreme Court on Friday held that judiciary has never endeavoured to make death penalty redundant or non-existent. The courts have never tried to avoid awarding capital punishment in deserving cases. "It has never been the effort of the Courts to somehow make this punishment [sentence of death] redundant and non-existent for all practical purposes," the Court observed in a judgment. Though the apex court has held that capital punishment should be awarded only in the rarest of rare cases and even proposed extended prison term without remission, the judiciary cannot ignore death penalty as an alternative punishment as long as it remains in the law books. Prince Andrew’s sex accuser Virginia Giuffre is set to address the sentencing of Ghislaine Maxwell. The 38-year-old is one of six women listed by US Government prosecutors who have been informed they have the right to provide impact statements to the New York Court on Tuesday. Along with Ms Giuffre, “Jane, Annie, Kate, Carolyn and Melissa” have also been listed as women who are allowed to address Judge Alison Nathan before she passes sentence. In a filing today, US Attorney Damian Williams wrote to the courts arguing all six had a right to be heard. “The Government respectfully submits this letter in response to the Court’s Order dated June 21, 2022 directing the Government to confirm that victims have been notified of the rights described in the Crime Victims’ Rights Act (CVRA) in advance of the sentencing scheduled to take place on June 28, 2022,” it read. The Supreme Court’s ruling Thursday in New York State Rifle & Pistol Association v. Bruen sets a precedent that could be used in challenges against other similar “may issue” state gun laws, according to legal experts. The Court sided with the plaintiffs in a 6-3 decision, with Justice Clarence Thomas writing the majority opinion . It ruled New York’s regulation requiring “proper cause” to obtain a license to conceal carry a handgun violates the Fourteenth Amendment by prohibiting a law-abiding citizen from bearing arms for self-defense purposes. In “may issue” states, authorities “have discretion to deny concealed-carry licenses even when the applicant satisfies the statutory criteria, usually because the applicant has not demonstrated cause or suitability for the relevant license,” Thomas wrote in the opinion. The parents of a Bowling Green State University student who died in a hazing incident last year have filed a lawsuit against the school, saying his death “could have been prevented.” Shari and Cory Foltz spoke with NBC News correspondent Erin McLaughlin on TODAY Thursday about taking legal action against the university after their son, Stone Foltz, 20, died in March 2021 from alcohol poisoning at an off-campus fraternity initiation event at the Ohio school. 5 former fraternity members sentenced in hazing death of Ohio college student

BOWLING GREEN, Ohio — Three former fraternity members were sentenced Thursday to jail terms for their roles in the hazing death of a Bowling Green State University student, while two others were ordered to serve house arrest. Jarrett Prizel, 19, of Olean, New York, Daylen Dunson, 22, of Cleveland, and Ben Boyers, 21, of Sylvania, Ohio, had all pleaded guilty to reckless homicide and hazing counts. Dunson and Boyers also pleaded guilty to obstructing justice, while Dunson also admitted to tampering with evidence. Niall Sweeney, 21, of Erie, Pennsylvania, and Aaron Lehane, 21, of Loveland, Ohio, both pleaded guilty to tampering with evidence and hazing, while Lehane also admitted to obstructing official business. Sister Abhaya murder case | HC suspends life sentence of convicts

A Division Bench of the Kerala High Court on Thursday suspended the sentence of life imprisonment awarded by the Thiruvananthapuram CBI Special Court to Fr. Thomas M. Kottoor and Sister Sephy, convicts in the Sister Abhaya murder case . The Bench comprising Justice K. Vinod Chandran and Justice C. Jayachandran also granted them bail. The order came on a petition seeking to suspend their sentences and grant them bail, filed by the convicts along with their appeals against the CBI Special Court verdict.
