The National Drug Control policy paper best captures VTCs as “a coordinated response involving the traditional partners found in drug courts and mental health courts, as well as the Department of Veterans Affairs healthcare networks, the Veterans Benefits Administration, State Departments of Veterans Affairs, volunteer veteran mentors, and veterans family support organizations.” VTCs build on the success of drug courts “which promote collaboration among the judiciary, community corrections agencies, drug treatment providers, and other community support groups” that has resulted in a “remarkable track record over the course of their 20‐year history.” In 2010, a collaborative effort between the Bureau of Justice Assistance (BJA), the VA, the National Drug Court Institute (NDCI), and numerous VTC professionals resulted in the Veterans Treatment Court Planning Initiative (VTCPI), the first VTC training program in the nation. The phenomenon we see in this case is familiar. Congress passes a broadly worded statute [as is permitted by Whitman v. American Trucking Associations]. The agency follows with regulations containing broad language, open-ended phrases, ambiguous standards and the like [as is permitted by Auer]. Then as years pass, the agency issues circulars or guidance or memoranda, explaining, interpreting, defining and often expanding the commands in the regulations [as is permitted by Perez]. One guidance document may yield another and then another and so on. Several words in a regulation may spawn hundreds of pages of text as the agency offers more and more detail regarding what its regulations demand of regulated entities.
